My personal prediction is there's at least something Vic loses on, KV loses on most things, so when KV files the inevitable (and allowed by statute) interlocutory appeal of the partial (and possibly total) denial of their TCPAs, Vic himself files a cross appeal of anything he lost on.

Considering the general assholery of the defendants I wouldn't be surprised to see yet another Texas Supreme Court decision on the TCPA that was supposed to stop litigation foolishness.
I don't think team Soy has the money to take things that far.

Oh yes, absolutely. If Funimation finds their way out of this, the long knives will come out for them. They were expecting Funimation to pay for their lawyers. Failing that, they expect Funimation to pay the settlements and judgements.

If Funimation gets out and leaves MoRonica and Marchi with a multi-million dollar loss, they'll suddenly "remember" all sorts of horrific crap about Funimation.

Either Funimation pays for all their idiots' legal crusade against common sense, or Funimation will be attacked by them. And even if they do, the second these types can't get any more money, attention, or career advancement out of Funimation, they'll turn on them anyway -- look at Sina Grace and Marvel.

Would you look at that, another BHBH document that is full of citations. The quality difference of the parties filings has been amazing. Must be a bitch to do a similar job to MoRonica's TCPA atrocity.

Actual Litigators seem to be worth the money. BHBH's filings are also rather pleasant to look at compared to the previous monstrosities we've been subjected to for the month.

They must see some strategic value in warning them how bad the TCPA hearing is going to go for them in a couple weeks. Rekieta's plane ticket costs money and they gave away information about how they plan to respond.

Nick has been telling them what they should do from the very beginning... if anything, it just causes them to double down, and they do the exact opposite. It's fairly predictable at this point.
 
My bet is after TCPA the defense gets serious about settling and/or turning on each other. Monica and Jaime's best option is to throw Funimation under the bus. Ron's best option is to throw Monica under the bus, and hope she successfully throws Funimation under the bus. Funimation is the only one who can take the hit and have a reasonable likelihood of surviving. Either way, the bus is running someone over after TCPA.

The light which is most favourable to the non-moving party is that unauthenticated evidence put forward by the defence is bullshit. That's not exactly going to help them.

Ron's best option is to throw Monica under the bus, and hope she successfully throws Funimation under the bus.

Is it actually possible to strike the entirety of a TCPA filing for underlying defect or rampant stupidity? And if so would that have any impact on the ability to immediately appeal? I'm thinking something like the core problem such as Lemonhead filing a single unfocused response for two unconnected individual defendants?

I honestly think they were (correctly) gambling on their hearing being scheduled for the same day as Funi's and counting on BHBH being unable to put together an adequate response to their abortion of a TCPA in a month.

15 pages as well. I am sure Chupp would appreciate this more than the 500+ pages of garbage that the defendants have put in their TCPA motion. It's explained pretty clearly and doesn't wax poetic about the statements that should be struck.

Its brutal too. Chupp will also appreciate how Ty actually cites case law and the rules of procedure to justify what he is arguing. This is pretty bad for Funi. If those affidavits are struck they have nothing to fall back on to sustain their TCPA motion.

It's amazing that these lawyers have no grasp of basic terms, but an asshole who's managed a bachelor's in criminal justice can cite the definitions to help them along. It's almost like all these people are the bottom 10% of their respective classes.

It just occurred to me that Casey and Lemon Fuhrer might actually be shitty lawyers and the only reason they got picked up for this is that they're cheap. I might be a bit late on this potential revelation but I like to give the benefit of the doubt that no one could be this bad aside from Douchette.

I would argue that perhaps Monica's TCPA was like one of those 3D pictures that you have to screw up your eyes to see.

But Ty, Nick and the resident legal experts on the Farms are consistently baffled and indignant so I am guessing it is just shit quality.

Correct me if I am wrong, but I could swear I read that in the event of a partial denial, they don't get an interlocutory Appeal? That would have to be appealed after a trial verdict. If any portions of the TCPA are held up they don't get the magic stop everything appeal. (Now I wish I could remember where I was reading that?)
