I considered this earlier, but the issue, I believe, is with blatancy.

Ty has been going onto Nick's show well before the lawsuit was even filed, a show that doesn't even consider itself alternative news (because it's him doing legal commentary for a couple hours). Said show is hosted by a man in Minnesota well into the night, has gotten 12k simultaneous viewers at its most popular, and has the VODs gathering less than 100k views on average. Ty has come in representing himself, linking his intents and words to his face directly.

On the other hand, Lemonade ran to an established publication (even if they're functionally a tabloid), not long after the filing of his TCPA, and had them write an article that he can hide behind to propagate the defamation currently being assessed in the court. This was the exact same reason why his TCPA was made the way that it was, and exactly the same reason why Rial and company fought as hard as they did to have Vic deposed first (so they could use the TCPA to block discovery for however long, and even if they lost it, they'd still have their sycophants maliciously representing his words in his depo). Hell, that's why they didn't just start off with filing a TCPA.

I disagree with @Immaculate Ape-- the issue is that they went to the press, because the issue is that they're using literally every mechanism possible to defame Vic, and for their newest trick, they've decided to employ the wrap up smear, hiding behind some other person with more credibility to perpetuate their claims. To make things worse, they're doing this with the downtime they were provided because Ty genuinely needed time to work through their combined 1k+ pages of nonsense, and they're doing this after they've made it clear that they wanted a jury.

It's neither illegal or unethical to do what was done. And it will have little to no effect on the case.

Was he a public figure when the alleged defamation occurred?

It's neither illegal or unethical to do what was done.

Public figure matters at the time of the defamation. You can't retroactively make someone a public figure and then tell them they're libel proof lol. That would be pants on head exceptional.

Jamie is a degenerate who really wants to be dicked down hard but most men are afraid of her insane feminazi nature.
I think it's also a case that she's mad that The Wall she plowed into recently wasn't awfully kind to her. She's one of the 'childless weirdos' YaBoi Zak talks about in the comics biz that got old, lost her looks and can't tease hormonal teen boys anymore, can't attract 54 year old men that women still fawn over and had limited career options before she went all Don Quioxti on this windmill.

I mean, he can certainly try to do that, but I'm pretty sure he couldn't even manage to convince himself that was a reasonable idea, much less the judge. The public figure argument is still very much up in the air, but this really won't do anything to affect it.

Vic definitely wants a jury. The outcome will likely be the same with or without a jury, but a jury has the potential to award a fuck-you sized verdict, while a judge will be more constrained by the objective facts.
 
I'm pretty sure not alot of people in fort worth even knew about this case till now. I can only imagine how uncomfortable it's going to be for him to leave the house.

It didn't seem to bother him going to conventions, where just about everybody knew at least part of the story. Vic's a big boy, I'm sure he can handle himself.

You know what sucks the most about all of this? If Vic's mother lives in Fort Worth, she probably woke up to find her son's name plastered in the news painted as rapist. These people really want to kill vic, don't they. I hope he finally decides to go all out on these guys and fucks their entire life up like how they've tried to fuck his up. Cos you can bet, even if they lose the case, there's going to be another article like this that comes out that paints vic as the rapist that got away.

I will guarantee you this, one of the very first things that Ty would have said to Vic when he first started the suit was something to the effect; "Now be VERY sure you want to do this, because the defense will do everything in their power to drag your name through the mud. This will be a very public case, so be ready."

I'm stunned that so many people think this is something unexpected.

Still believe this move was to grease the cogs for the trial, post-TCPA. There is literally no meaningful reason to do this for the TCPA. The timing here is paramount, because if he and his clients believed the TCPA would win outright, they'd do this AFTER the victory to slam dunk on Vic.

Literally no point in running to a publication prior to a TCPA ruling, other than conceding the TCPA isn't going to win and setting the stage before the ruling is handed down

What happens if they try something that exceptional and try to pass it off as "He was always a public figure, look here right in the article it says 'In the world of English-dubbed anime, Grapevine resident Vic Mignogna is a voice to be reckoned with.' if he wasn't a public figure why how would she know him?".

The defendants misread the room since the beginning. They thought they wanted a jury, once it was decided to be in Tarrant County, I'm sure that opinion changed real quick. They thought they could control the public narrative, but have been shown that their games won't work on the Judge, and they're not getting the reaction they want out of the locals/community either

This is the first time I've seen people so determined to put someone in the ground in the most undignified way possible without actually trying to murder him and mutilate his body.

I wasn't prepared for this level of coordinated villainy against one man.

Can you imagine what it must feel like to be vic and looking at the front cover of that article.

Monica and jamie looking heroic and being brave, calling out the predator vic mignonga.

What vic says in this video truly makes me believe if vic never got in contact with nick and if we weren't here to support vic. I truly believe vic would have ended it all

I hope TY bankrupts these people into the ground for what they have done to vic
