So, pretty damning stuff for Rial/Toye/Marchi's defense here.

Considering Denbow's investigation only investigated claims that Rial made, or Rial brought forward on behalf of others, and the social media firestorm they reference later in the affidavits all include statements made by Rial and Marchi.

Not to mention, Funi admits to breaking their own contract obligations by terminating him via telephone, and not in writing as stated in the contract.

Lots of shell games being played, and Law Twits/KVs are celebrating this filing :story:

Im sure somewhere someone can argue that was a sound and rational course of action. However, the thing they failed to notice is that we live in reality. Its a common enough mistake among KV, lets not be too mean to them.

If they broke their own written procedures, it could possibly be argued that they may not have even terminated him.

Not completely sure what the rules around that in Texas are, though one thing does stick out.

I would say this could be leveraged to argue that Funimation did not follow their own rules, that piled on with the fact that Funimation didn't even conduct their own investigation into Vic - just relied on a 3rd parties, also adding on the fact that they were apparently completely unaware of any misdeeds prior to January 16th.

With social media articles surfacing as early as January 9th, that's an entire week that Scott Boratto failed to report any issues to Funi's execs.

Lots of loose threads that I would absolutely be ripping into if I were BHBH, but I'm sure they don't need a layman to tell them how to do their job, unline Lemoine who needs the Ginyu Force on the Threadnought to tell him how to do his

Overall:

Very sloppy work by Funimation that will likely burn their ass. That could possibly lose them their TCPA claim because they may not be able to prove that they weren't reckless in their disregard for the truth.
 
can't sue for wrongful termination because vic wasn't an employee
but he was a contractor, they had a contract that both sides were bound to, and the part about how to terminate the contract was apparently not followed correctly, so beard could maybe theoretically sue for breach of contract

these TPCAs are absolute dumpster fires. I feel bad for the trees that had to be cut down so the paper could be wasted like that. Such a shame....

Also a waste of the energy used to project them to people's faces through computer screens. Could probably have used that energy to filter water for kids in Africa for a few days instead.

Even the con's seem to disregard contracts considering we've been hearing story's where con's allowed their staff to put Vic in different rooms than what was originally agreed upon while also failing to inform Vic that a panel may be longer then otherwise schedule.
Most of the issues is becuase Vic expected the staff to follow the schedule and the contract but when they didn't - and he could only talk to the staffers - they started to gossip and twist the truth to the point that no one knows what actually happened besides staffers who only do one Con.
 
Is lawtwitter pro monica/marchi, pro funi, or just anti beard? i'm curious how they'll react once the defendants start pivoting against each other after the TCPA fails
