So, are there any updates on the legal processes? I heard nick rekieta says we may have an answer soon, so I wonder what will be the fate of the tcpa's.

Everything is on hold until the September 6 hearing on all the TCPA. Then there is up to 30 days the judge can take to render his verdict.

As to round 2 speculation, I think that round 2 is actually going to be the addition of people to the current lawsuit - namely Sabat and anyone else who lives in Texas. My reasoning for this is that you need to group defendants together properly and since this is a state case that means take care of everybody in Texas. Round 3 will be a federal lawsuit that can bring in Jawbitch, Elderkin, ANN, etc. That's if they can get to it that is. Obviously we shall see.

The main thing that makes it believable to me is that one of Popehat's favorite things is mocking defamation lawsuits based on mean things said on the Internet. In fairness to Popehat and his sycophants, the vast majority of these cases are stupid and frivolous, so it's pretty easy to mock them; most of the time, you're gonna be right. The problem is that they seem to have missed that this case isn't a Brett Kimberlin situation, and are continuing to treat it like it is.

It's pigheaded obduracy and the standard situation of a man with a hammer thinking everything is a nail. Most of those nutty cases are the kind of thing you can predict, time and again, will be thrown out on a 12(b)(6) motion or its equivalent, because there's no cause of action, no damage, and the statements are harmless Internet badinage.

Here you have very serious damage based on people in the real world actually believing the defamation, which is clearly defamation per se and you'd have to be blind not to see it, even if you believed the statements themselves to be true, and acting on it, with demonstrable harm as a result.
