This is nuts.

The only thing that really matters is the first 35, maybe the first 50 pages. That's the actual motion, maybe motions if those strikes are new. And those are very succinct and easy to read, with all kinds of citations.

Contrast the jibberish the other side is putting out.

The thing is, it doesn't need to survive. This is a Gloves Off move, where by Beard has done what they did to Vic, defamed Sabat using the privilege of the court. The only difference, this has more meat than anything thrown at Vic.

Wonder if Chuck is who gave Nick that audio? It seems that this and the Funileaks were pretty much tailored to nailing Sabat the Fagat to the wall.

Read the first 35 pages. The only part that seemed iffy was the section on limited public figure doctrine.

Thought other people might apply those tests differently. But I know enough not to second guess Ty's team.

Now I'm absolutely furious towards the VAs but especially Gen. He's supposed to be a leader and is letting stupid, weak-willed underlings create problems for his company. There's a part of me that wants to say he's letting his friends walk all over him, but now I suspect he's doing this to torpedo the relationship with Sony.

I mean, the guy is not stupid. He knew letting staff act this way could lead to lawsuits and threaten the company's interests. He's the President of Funimation - how is this anything but deliberate?

Dude he sold it to Sony before this even started and it's likely his position as President is merely on paper at this point.

His feckless attitude is disappointing but he's the very dude who created a malevolent corporation like Funimation in the first place.

Don't want to derail a thread about the lawsuit with speculation about sources.

But the shittiest smell in the room is Gen Fukunaga, President of Funimation.

- He founded Funimation and is now an employee of Sony.

- He has family at Toei who have influence ove the DBZ franchise.

- He has other business interests and knows enough where he could set up a competitor.

- If anything in Chuck's affidavit is to be believed, he protects his sycophants over the interests of the company.

Founders who sell their companies go on to sabotage them all the time. The decisions he's made are huge red flags. There's no captain on the ship, just a vacationer sunning himself with his sycophants, expecting the boat to run on it's own.

Sounds like hearsay at first glance, but it's not offered for the truth of what (if anything) Toye actually said, just that he was coaching Monica while she talked.

Got to the public figure part, and while IANAL, it looks pretty solid to me. Rather than making a proactive case that vic is not a public figure he just outlined how the opposition fundamentally failed to meet any criteria for arguing it.
