objects to Defendants’ evidence, shows they fail to meet their burdens, meets his burden, and
requests that the Court strike Defendants’ evidence and deny their motions to dismiss.

IV. CONCLUSION & PRAYER

WHEREFORE, Plaintiff requests that the Court sustain his objections, strike
Funimation’s evidence as discussed above, deny Funimation’s Motion, and award him such

The rule against hearsay is more about preserving due process rights in the court of law. If a civil lawsuit uses Johnny's affidavit that he heard Timmy say that I hit him, I'm denied my right to cross-examine the actual witness (Timmy) to the actions under dispute (whether or not I hit Timmy). Furthermore, allowing hearsay would open the door to false testimony; instead of lying to the court under oath, you lie to someone else who truthfully testifies that they heard those lies.

There's other procedural stuff about procuring the best and most direct evidence about things too, but the big concern is due process.
So because all the people in Chucks affidavits are Funi employees Funi and the other defendants can get statements directly from them and therefore Funi and the other defendants have due process correct?

There's a huge HR bombshell in Chuck Huber's affidavit that I haven't seen others point out.

This man is calling other people incels? I know he has a couple of crotch-fruit but he looks like he needs to beg for sex. Wonder how much begging he had to get to get the wife to say yes.

Which begs a question that would normally sound absurd, but might be legitimate: did Funi ever actually tell its employees "casting couch" behavior was a Bad Thing and not to do it?

If Huber's claims are true, and Funi didn't post policies or guidelines regarding sexual harassment (which is very common in small businesses), or they didn't provide sexual harassment/sensitivity training... then they can't hold employees accountable for breaking policies the first time. Huber also says the previous Funi "investigation" was about Vic being hard to work with, which means Denbow's January investigation may have been the first time Vic heard about any such thing in an official capacity.

I don't know the specifics of Texas employment law, but now that Funi is claiming the inappropriate behavior in Denbow's investigation was the cause for dismissal, Vic may have a wrongful termination case on this alone.
How would he know the others were never given a handbook? That seems like a huge statement of fact Im not sure he can attest to knowing. Either way he should know if he and Vic werent given a handbook.
