If a civil lawsuit uses Johnny's affidavit that he heard Timmy say that I hit him, I'm denied my right to cross-examine the actual witness (Timmy) to the actions under dispute (whether or not I hit Timmy). Which begs a question that would normally sound absurd, but might be legitimate: did Funi ever actually tell its employees "casting couch" behavior was a Bad Thing and not to do it?

If Huber's claims are true, and Funi didn't post policies or guidelines regarding sexual harassment (which is very common in small businesses), or they didn't provide sexual harassment/sensitivity training... then they can't hold employees accountable for breaking policies the first time. Huber also says the previous Funi "investigation" was about Vic being hard to work with, which means Denbow's January investigation may have been the first time Vic heard about any such thing in an official capacity.

I don't know the specifics of Texas employment law, but now that Funi is claiming the inappropriate behavior in Denbow's investigation was the cause for dismissal, Vic may have a wrongful termination case on this alone.

How would he know the others were never given a handbook? That seems like a huge statement of fact Im not sure he can attest to knowing. Either way he should know if he and Vic werent given a handbook.
