At least the hearing will be tomorrow, will be interesting to find out if the new law firm has been on board for a while and was just announced a day before or if they came on more recently. I very much think he was brought in for the contract/employee dispute, and seems to speak to Ty's confidence for this to go past TCPA, at least with Funimation.

Shame that I am not within striking distance of Texas, I'd love to be in that room to see the circus.

While law is technically practiced in view of the public, most lawyers usually argue in obscurity because the things they're arguing about are tedious and boring. Appeals really depend on how the Judge rules. If he throws everything out or tosses all of the TCPA there will almost certainly be an appeal. In a mixed decision things get murkier.

I think the catch is in this. Vic will be more than ready to settle with the only condition that the defendant, who wants to get off the hook, must publicly completely disclaim his own words. Public apology.

And the problem of the defendants is that no one but Funimation can even theoretically go for it. Once they do so, they are done.

So they will fight back in court until their money runs out, and then the court will just rule in Vic's favor that they owe him money.

That's if Funimation doesn't make their move. If Funimation finally decides to turn everyone in, apologize to Vic, pay him compensation and take him back, the case will close very quickly.

Funimation has other options. They can get off the hook through TCPA now, or through an appeal (if they are lucky). They can try to prolong the lawsuit itself for years (they have money).

The funny thing with a company that's owned by a third party is that they actually don't have money. They have a responsibility towards their owners to spend as little as possible on this lawsuit. If Funimation tries stalling tactics and keeps it going for years, then Sony would not be happy, because in the end it's Sony paying for the lawsuit over trouble started by Funimation. The most likely scenario if Funimation tried that would be that Sony would just shut them down because it's cheaper. Funimation doesn't really have that many options, their money isn't their own.

Not sure, I stopped bothering to look into the photo when Ty and Nick basically admitted he wasn't in their presence. When Nick streamed last night he never once said or indicated Ty has notarized the documents properly or that people claiming Ty and the Slatosch were in different places were wrong. Instead he went with "Does it matter though?" reinforcing the idea that Ty and the affiant(s) were not in the same location.

Ty's response to stream chat was just "I admit, I fucked up I won't make excuses" etc...

At this point there is every reason to believe that the documents were not notarized properly. As a reminder:
- Slatosch was scheduled to be a con during this time, and did post a photo at the very least implying he was there, although he may not have been physically in the frame, so maybe tried to fake being there for some reason? Unlikely and unnecessary imo, but whatever, moving on.
- Ty has repeatedly affirmed there were "defects in form" and while he hasn't specifically enumerated what "defects in form" means, he immediately withdrew the documents in question and resubmitted minus the notary and has as of yet not produced any Notary log to verify the notarization was proper
- Ty has admitted to messing up, and never specifically denied that Slatosch was in San Antonio
- The running line by Nick and Ty has not been to deny the improper Notary, but instead to contest the relevance or significance of it

If anyone still denies that Ty fucked up the Notary they are fighting a battle even Ty and Nick have opted out of. Argue that you think it doesn't matter, but arguing it didn't happen at this point is... beyond optimistic.

Lemonjello assumes that Chris can be the only person using or even running that instagram account. He also assumes that the person who took that picture and the person using the account are the same person.

It could easily be a case that someone who works for Kamehacon was at their booth and took the picture. That person either has access to the instagram account or sent the picture to someone who does maybe even Chris himself. That person or Chris then uploaded the picture to his instagram in all of the 5 minutes he needed to do so right before Chris signed his affidavit in from of Ty in Tyler Texas.

This is all the "evidence" Lemon Party has. This is it. He has nothing else.

Other than catching him at or the night before the hearing which seems preferable, why are people laughing at the motion for sanctions? Any lawyer worth hiring would absolutely fire off a motion for sanctions about the notary stuff and might as well include the late filing bit while he's at it. It seems like a rather good enough filing that gets the point across while asking for the moon. Asking for the moon while actually hoping for a slice of cheese isn't exactly a new practice in law.

I don't foresee this affecting Vic or necessarily affecting his case. I could definitely see Ty getting sanctioned over it and having to pay monetary damages commensurate with the time it took to suss out the interesting notarial practices and fees associated with filing something about it. I could also see this being bad for Ty's notary license. At least someone will finally be able to submit a good ethics complaint to the Texas Bar Association.
