And not creating some kind of chart to tie them all together, like why the fuck wouldn't you do that? I have been wondering about this as I have read the public documents, but I just assumed the TCPA bar was low enough that it could come later. IDK.
Prosecuters hire social media experts to do this shit all the time, it's an entire field and they had a $200,000 warchest. It just seemed odd to me, and even moreso now.
It should have been obvious he needed the context when Ron kept mentioning in the deposition he didn't know WHAT THE FUCKING CONTEXT WAS!!!

Waiting for transcripts I think. Also Marchi's case dismissed is not really a big surprise. There wasn't much in the proof-pile and context, but will be fun to see a re-run next year on appeals. If the decide to go that route. Personally I feel like she isn't worth it, like others are worth it. We'll see.

Any idea on when the transcripts usually go live after a hearing? I have no idea where to even look for them after the fact.

Nope, they were pulled out of the TCPA response due to the notary screwup. The Second Amended Complaint put them back in as sworn affidavits, but the judge isn't considering them.

The impression I'm getting is that the Judge isn't handling this as a TCPA hearing. He shouldn't be acting as a fact finder.
 
This case is exposing a glaring weakness in the current day legal system. Basically social media has circumvented a lot of the protections the courts levied in the era before the internet was so permeated in society.

While the Judge may not think some things are relevant, in terms of the definition of law, those laws weren't written/amended with modern society's approach in mind. Thus, we're seeing it's dichotomy in action.
Basically the law is for fags. In a decent society Vic would have been entitled to duel Ron unless he got his bitch in line, etc etc.

Complaining about how things didn't go right is a bit silly, when you consider:
  1. Decadent Western society is fucked
  2. The law is fucked
  3. Vic wanted to go easy on these shitbirds rather than go full scorched earth and absolutely ruin their lives
#3 is the only one that there's any likelihood of changing in a positive manner.

This is highly appealable. Slatosch claims in his affidavit that he had a conversation with Monica aboutVic's presence at KamehaCon, and Ron was there. He even says he could hear her and Ron talking in the background and agreeing. When Chris brought Vic back, Monica followed through on her threat to have other voice actors cancel, which they did. Keep in mind that the Judge has to put all this in writing, and if he's being truthful about reading the affidavits and considering them in his decision-making,verbal rulings have no real say until it's in writing. At the very least, appeals are an option.

What a train wreck from the initial sounds. The law seemed sound and their case was presented, the public, neatly. This may be a case that gets cited in years to come if chupp continues along this path. Very scary for tcpa rulings in the future.

There's a one-year statute of limitations for libel/slander, and the TCPA doesn't say whether the claims are dismissed with or without prejudice, so BHBH can come back and try to get through another TCPA motion from Marchi with new evidence later if they're willing to risk paying for her attorney costs again.
