Ty's notary fuck up really screwed this, then. He withdrew the slamdunk evidence, and when it was reinstated in the second amended petition, Chupp said he wouldn't be considering it.

It seems like the judge is acting like a fact-finder, in contravention of the scope and intent of TCPA. One of the lawyers on Nick's Discord says that getting a successful appeal of evidentiary issues is very low, and he's right. That being said, if it can be shown the judge err'd on his decision of Vic being a LPPF then everything comes back, and it's likely then the TCPA is redone for all defendants.

Assuming this is correct and the affidavits are out, that is a huge fuck up on Ty's part even if it can be appealed.

TBF, it appears from the details we have, that Chupp's mind was already made up that none of it qualified under the standard of evidence he was looking for. Not what the standard of evidence according to the law, is.

It would have been irrelevant even if the affidavits were admissible. Chupp already made up his mind about how the law reads before the hearing.
