Talking to my lawyer, who has also been following today's events.
First - he's critical of the Tweets in the motions, but says there's also problems with including the entire thread. Said his firm leaves out the thread and demands context on the witness stand. He wants to read transcripts to understand the Judge's reasoning better but believes this is not typical handling of social media in an anti-slapp case.
Second - he believes this is being treated like an evidentiary hearing, not an anti-slapp hearing. Judge is setting the bar way too high, rulings won't survive appeal. Suspects Chupp has been watching Nick's videos and may feel personally offended. "Sometimes the Judge decides to send a message..."
Third - most anti-slapp motions go through appeals. Problems with how evidence was interpreted are common. A bad outcome is not a final outcome.
