Yeeah, feeling this was less Ty screwing up and more the Judge applying the wrong standard.

An appeal could fix that issue.
 
Most of the damages are in the defamation claim. While the TI should be an absolute slam dunk as to existing contract, and it's completely inexplicable that count would go, those damages would only be related to Kamehacon, which he was actually invited back to, so the damages were always going to be difficult to prove.

Unless he threw out the Slatosch Declaration, that decision is incomprehensible. He explicitly said he broke the contract because of interference by Toye.

The other cause of action was tortious interference with prospective business relations, which would have been a lot more damages but it's more difficult to prove. If the defamation had been thrown out but not that, it would have been impossible to prove because unlike TI with existing contract, you need another tort to prove it.

Defamation by itself is the meatiest of the causes of action. However, if Chupp is hostile to the whole case, it might be difficult to get there, assuming he isn't just reserving judgment to come up with a written reason to throw it out.

Only the defendant can appeal this automatically if they wish to do so unless everything is thrown out and the case is over.

Only if the case is dismissed as to all causes of action against all parties. Otherwise, it is an interlocutory appeal, meaning an appeal during the pendency of a case. In general, such appeals aren't allowed.

However, the defense has the right under the TCPA itself to appeal any denials of a TCPA motion, partial or otherwise, and may do so, if Judge Chupp doesn't just throw out everything in his written opinion.

If the defense appeals as of right and the plaintiff appeals for permission to appeal, it's likely the court hears both appeals. That's just a guess, though. Conceivably, they could hear just the defense appeal while refusing the plaintiff's appeal. I just don't see why that would make sense.

Tbh if KV walks out Scot free they'll have nothing to whine about. People will stop caring and stop interacting. It was like what happened with Heidi and Jared. People mobbed her at first but once she felt she was winning people stopped engaging with her like they did before. Most importantly, they exposed themselves and will likely not be able to find employment beyond Funi and RT and friends.


But if they lose they can constantly bring it up and stir up drama since there was no resolution. They can tease their truth and fabricated evidence. They can rub salt into their own wounds. People will pity them and they'll get pity jobs because that's current year agenda.

If Vic loses, he can move on. He won't be the same but he'll move on.

Its a bit of both, really. Ty got too smart for his own good and failed to make a compelling case, BUT Chupp also apparently lost his marbles and made a VERY easily appeal ble decision.
