why? isn't this a board for weeb wars? I'm fairly certain, unless word definitions have changed, that it emcompasses more than the vic drama. it's just the latest fad right now. once it dies down, we can move onto other topics... like crunchyrolls money laundering/where tf is high spice guardian.

This was supposed to be a TCPA hearing, Ie. Arguing the 1st amendment

But, for some reason the judgment was made on alot of things.

I thought, a TCPA puts a hold on discovery. Then you have a hearing on that TCPA to see if the argument constitutes free speech

If it does not, then proper discovery can take place, evidence can be gathered and the case can go to trial for judgment


Seems the judge treated this hearing like a trial.

The only question that was supposed to be raised today was

"Is this or is this not free speech?"

I have no idea why rulings on TI among other things things were passed without the opportunity to to do proper discovery.
 
This is actually a preferable development, would be a nice part of a case study of how badly the current legal system and its Agents are keeping up with the advancement of Information Technology.

Yep, I was getting worried there for a hot second that Funi would manage to get away. The fact they didn't is a win imo. That is where the money is anyway, and the juiciest evidence...and Sabat.
 
People seem to be acting like the defamation and conspiracy got through, but Chupp just hasn't passed his decision yet. So it could still go either way. I think it really goes to show how bad Ty fucked things up, when Marchi, and TI are completely dismissed outright, while Chupp is still considering the others.

Nobody is acting like anything got through.

People are just snapping at any movement and need to calm tf down. Not everything immediately got tossed, which is telling considering what immediately got tossed.
 
It's going to be hilarious to watch. I like the guy and I hope he doesn't go full lolcow on us, but after this dismal defeat, we might be seeing the birth of a new cow or another casualty of Youtube fame.
While he may have a personal investment - I don't think he will go full lolcow, nor do I think he'll be another casualty. He's genuinely funny, and is aware. Even if this case goes full Titanic, there'll always be more amusing cases for him to follow and lawsplain.

true but there was a thread before which seemed weird to me simply because the anime fandom has so many ridiculous controversies and cows.

its a sort of chandler in and of itself if I were to compare the fandom to any other cow.
 
I have to drive home now, but quick notes:

Judge did not seem to care about Notary issue, everything dropped against Marchi, everything but defamation dropped from Funi, and everything but defamation and social conspiracy dropped against MoRon.
Oh boy, this is unexpected but as many have already said, not unwelcome.

Unless he threw out the Slatosch Declaration, that decision is incomprehensible. He explicitly said he broke the contract because of interference by Toye.
Apparently the second amended petition wasn't even considered, so the strong evidence for TI was gone.

Soooo, basically, the KickVic people are treating today like it's a full victory and the StandWithVic people are treating today like it's a full failure.

Based on what I've been reading here, neither are true.

Here's the thing.

Based on how Chupp tossed out a bunch of stuff immediately, there is no reason to be optimistic that he will not bring down defamation in the written judgment.

So we'll be seeing appeals. Meanwhile, Vic's funds are tied into the appearance that he has a chance. It does not look good for his war chest (EDIT: as in it will likely not increase much past this).
