None of this seems to be thanks to Lemwah's ingenuity, actually. It's that plaintiff didn't do their best job, but as long as their case isn't dismissed entirely, it's not a loss. There's that and the fact that judge doesn't seem to like his job.

I wouldn't know, until we get to see the transcripts, I can only assume that Lemoine grabbed the Judge by the pussy and let him to the promised land. I seriously doubt that Judge Chupp is some sort of incompetent invalid.

actually something just occured to me. isn't it improper for a judge to rule on a case as a whole in a tcpa hearing? I mean sure he can say it applies to certain pleadings and stuff.... but making case rulings not based on TCPA in a TCPA hearing sounds like a move that a retard judge would do and get laughed at by everyone around him and then overruled.
 
So for the experts can someone verify what happened. From what I got, Ty massively screwed up and TI was removed from all parties somehow. Marchi is completely dismissed from the case but defamation for everyone else is still in the air but TI may be appealed to another judge. Did I miss something?

Slatosch was Kamehacon and he was reinvited, so even if you could prove TI-EC's other elements there's no damages.

My guess is that Chupp wants to think things over before he tosses them. Monica's defamation might survive because falsity might be enough with Vic's declaration to survive TCPA, but even then I don't think Ty tied any contract cancellations to Monica's statement.

Ty shouldn't have to tie specific damages to the allegedly defamatory statements - accusations of criminal activity or sexual misconduct are assumed to damage one's reputation.
 
Look, it's weird and people are taking account from what appears to be someone who is deaf and biased. Yes some things were dismissed, it seems odd based on what the judge said via 3rd party. But we don't now what was actually said, we need a transcript or more witnesses. There are appeals, so don't go freaking out.
 
That said, the blue balls in that we have to wait until tomorrow for Nick to do a stream about it is what rustles my jimmies most. May the transcripts come quick.

Better waiting a day and giving it some thought than doing a drunken madstream and chimping out on the judge and turning into a lolcow himself.
 
I've read most of this shit since February, and from what I can see, Ty Beard and BHBH was mainly accepted on memetic grounds rather than any serious look into how they dealt with previous cases (J. Sean and Casey got more of a hard look there). Most everyone assumed Judge Chupp was on Ty's side and was sick of the Casey and J. Sean's antics, and no one looked into his background (other than he was a younger judge and a Republican).

Maybe this is like when Souther BTFOs Ken in Fist of the North Star. Or since Ty loves his WWII, this is autumn 1942 when the Axis is advancing on Egypt, Japan is smashing through Southeast Asia and China, and Stalingrad and Leningrad are due to fall any day.

Well that concludes the show folks. Appeals will come and go, but the majority of the damage has already been done. Thots will hold this up as a shining victory for teh wahmens, metoo culture will do a victory lap, Vic won't get major roles again. Nick will slowly stop talking about it as much, and BHBH will return to obscurity.

Even if things turn, the first blow is the most decisive in the public eye. A victory will still have that asterisk attached.

It's very likely we're missing a lot of the details about what he did, and the KEY TERMS being misunderstood by laypeople who don't know the difference between DISMISSAL and RESERVATION.

Nick alluded that there were some hard decisions made, but some reservations and some points to be considered. So, I chalk this hysteria up to people who aren't lawyers, celebrating about what they think is a total victory when it's not even decided.
 
Even if Vic loses every case, we still exposed Ron Toye as a wife beater, Chris Sabat as a creep, everyone else as degenerates, and now Funimation may be in hot water with Toei.

Sadly sabat will still have his scared ointment couches, Toye can give snack trays to drexel and Toei would probably won't do shit since it's not hurting the bottom dollar.

Ty can always appeal I believe and this serves as lesson. All he needs to do is clean things up a little more. The last minute denials, tech issues and general boomery didn't help. We'll need to endure KV gloating for a while. But this is far from over.
Always remember though, even if Vic loses this case, it doesn't mean he's actually guilty of anything they are saying he is guilty of.

I'm not worried because while I was hoping for Vic to get justice, I was more looking forward to lulz... and if Chupp ruled like I think he did... well we just found a cow and once appeals get through we're going to see that cow produce milk.

We are waiting for clarification on the TI.

The only one that seems to be in the clear is Marchi. Which was expected by a lot of people.
