Finally read up everything.
I'm actually amazed the TI was dropped and defamation stayed in. I always thought the defamation causes were the ones likely to be dropped with the TI causes being the strongest.

For the Ron TI drop, I'm more surprised, it sounded like Chupp dropped it because Ron only did one instance of TI and that somehow isn't enough since it only happened to one con?

I don't understand how strong monetary damage can be calculated from defamation without the TI since his business prospects were interfered with. Is that mostly a jury thing where it is punitive only?


This is doubly annoying as Ron never complied with discovery. Ty could not answer this because outside khameacon he cant know who else Ron talked too.
 
It just pisses me off that this was supposedly a bad day for Vic because of Ty's incompetence. If this was all because of a judge misreading law or whatever it'd be more bearable.

What I am going to assert real quick is that one thing is clear: Chupp fucked up and now is going to get exposed to his collegues to be a massive retard that doesn't know how to make rulings because he let TI go on even Ron Toye who undeniably did it. There is no way for him to salvage his reputation from that beyond making a written opinion that basically says he rescinds his prior ruling regarding it and apologizes for the confusion. The others you can technically make arguments but Ty had the dms on the books long before this hearing and for Chupp to either make a invalid ruling or to ignore evidence will let ty win on appeals and appeals are a good way to slap egg on a judge's face without insulting them directly.

tldr: Appeals Court likely to wonder why the hell Chupp ruled/acted the way he did and simply conclude he's an idiot and overrule his own rulings. Something most judge's try to avoid except judge lolcow chupp.
 
I was at the hearing. I am not KickVic or IStandWithVic, just curious how a case like this plays out. However, feel free not to trust some anonymous newfag (and apparently not the only one joining for this thread).

It'll take time for me to read the thread from the start. Before then, what are the remaining open questions people have as to what happened? I can provide facts and impressions, but would prefer to avoid anything too speculative.

but he let ron off the hook for TI despite clear evidence to the contrary. There is simply no explanation other than he's a lolcow in the waiting. and after appeals happen, he's going to chimp out and make himself a proper one. I'm calling it now.

How else do you explain it? Because it's either he's stupid or he didn't read any of the motions/evidence and made his decisions without looking at it and thus was extremely unprofessional which means when the appeals court rightly calls him out he'll chimp out and we get the same result as if he's just retarded.

I dont understand this one. For exemple If i fail to commit a fraud cant i still be charged for attempted fraud? Wouldnt the same apply? So TI only applies if it there was damage?
