Nah, the TCPA hearing is there to say "OK, we need to know you're not full of shit, so put up or shut up."
He's supposed to come with the evidence; which is the whole point of anti-SLAPP laws. They're to expedite defamation suits, they're there to filter out ungrounded suits. Why? Because the Texas legislature felt that the benefits of preventing ungrounded anti-SLAPP suits exceeded the costs of making legitimate defamation suits harder to win.
Which is bullshit because that just increases the costs for common man to access the legal system in the same way being sued for calling some guy a cuck increases the costs on the common man. But Texas can do whatever they want since that's how they keep voting.

I'm paraphrasing because I can't rewind on DLive for some reason, but basically Rackets said that the TI dismissal was shocking because Ty had them "dead to rights" with the contract and the KC text messages from Toye, but also that the defamation sticking to MoRon and Funi were the most valuable claims, and those are the one that stuck.

Also, big ups to Gator for streaming right now, I feel that helps everyone's anxiety.

I had known vaguely about the farms beforehand but this whole situation is what made me actively check out the site, then lurk for several months before making an account. I very much appreciate the site's philosophy of just being an observer keeping track of bizarre situations or people, was never a fan of people that actively throw themselves into the mudpile.

Same here. I wasn't excusing it or anything, just stating the obvious, really.

Well this was a disaster. The case isn't lost, but could have been a lot better. I've had my worries about Ty from his last appearance on Nick's show. Frankly, I'm not impressed with his and performance.
From letting himself be constantly be pushed around by opposing counsel, to failing to present all the evidence to the court because of the half-assery with the prima facie case. Which led to losing the TI causes and letting one defendant get away. Sorry Nick, seems you bet too much on the wrong horse. After all the free autistic archiving from kf and with your opponents constantly shooting themselves in the foot, how do you fuck up so badly?

Like the only thing that was lost was TI and even then MoRon are still on the hook for social conspiracy from what I'm reading and alot of shit can be appealed

It's not odd at all, looking at the context.

Ty couldn't provide evidence beyond inference that Rial and Toye committed TI. He stated that the reason he couldn't provide proof was because of the discovery stay, and the Judge didn't buy it.
I can see the Judge's point. There was plenty of time before the stay to have gathered the proper evidence for it. The stay just seems to show that Ty was dragging his heels with it. Good job to team Moron for pulling that shit.
But from what I've seen here there was new evidence popping up so frequently that the stay really did fuck Ty. I'm glad they can appeal that decision or whatever.
The defamation claim without TI feels weird and almost pointless, like it's just suing for petty reasons instead of actual financial damages. But then again it's the American court system and that's what it's best at so I shouldn't be surprised.

So Ty fucked up, the judge is a fussy asshole and Marchi is off the hook but we all saw that coming so who cares. That about cover it?

Ty went in with a case for TCPA, and providing a prima facie case. The Judge wanted specifics and asked for a standard of evidence that went beyond a prima facie showing and refused to consider anything less
 
That would be a valid question if Ty was being unpersoned... no one's asking for that.
There are folks in this thread that are going balls to the wall "SKY IS FALLING" and people are hand wringing like it's the end of the goddamn world.

For those of you that think this one single solitary court appearance is the end: It's not, this isn't Law and Fucking Order on TV, these cases go on and on and on.

This is a goddamn campaign and not a some silly lil one and done battle.

Think of it as this is the first time both sides have met in war and , like the old saying goes, once the enemy is met all battle plans go out the window. Neither LemonJello nor EmperorTy knew what to make of Chupp and that's what cost both sides heavily. Some things worked out, others didn't, in the end the court proceeding will go on as they must.
 
It would have been unusual for either extreme (everything tossed or everything sustained) to have come to pass in the hearing. Nor was it out of the question for Marchi to get off scot free. But the way the TI stuff went down, I have to admit, is a real head-scratcher.
