Seriously people are too invested in another guys lawsuit, it's becoming really Gamergate-esque with a few entertaining guys holding it all up and a whole heap of hangers-on.

Much as I'd like to see him come out on top, be realistic. Anything that goes before the judge can and will go awry.

I'm not worried about the court of opinion.
ISWV and the normies made the funimation hashtag N°1 trend in the USA for a few hours, first it was about the audio leaks, then about the casting couch.
Even now, right after that hearing, the tag is still poping regularly, and while KV is sliding a few celebration tweets, it's mostly about Sabat & Cie.
So yeah, not worried at all about the court of opinion, they're already losing that battle.
 
So what do appeals look like at this point? It seems like the judge wanted more than just prima facie, which seems kinda strange to me.
Well, it would take a while, but as long as it's not absurdly boomer judges that also dismisses everything because he's just so above anime and d list voice actors, it would be pretty clear cut. Problem is, this was also about as clear cut as a showing of clear and specific evidence could get. I think the chance of appeals court being more boomer than a judge is decently high.
As much as Ty absolutely fucked up, here's the facts of today's hearing:
-Ty brought exactly what was required for TCPA
-The judge said that it wasn't good enough and he needs more, even though that's the opposite of what the statute says
Ty fucking up has no bearing on this.
 
So curious @AnOminous , can a Judge make enough bad calls to get himself removed from overseeing a lawsuit? Trying to figure some of these weird things he did like the whole "Hey there are 25 people here, he's a public figure" or the change in the required level of evidence.

If he was acting on the first amended complaint and the TCPA opposition that had all the affidavits withdrawn, all that stuff, Vic's own claims, Chris Slatosch's, Chuck Huber's, weren't even in evidence so the judge didn't have a prima facie case, and the judge didn't make a mistake, unless refusing to accept Ty's last minute desperation filing was a mistake.

If nothing was in evidence, that's not the judge's fault.

It does if the reason there isn't a prima facie case is none of the evidence was admitted, and the reason for it not being admitted was Ty's fuckup.

The affidavits were raised and discussed, apparently, and Chupp didn't appear to care or make a fuss about it. It's the sticking points that he made dismissals over which are questionable

So the notary thing was the biggest fuckup because Ty had to rescind evidence and was left shorthanded because the evidence was resubmitted past deadline?

From what I have read, the affidavits were there. He just didn't care about them.
 
When, and under what circumstances, can Vic appeal the decisions made today and how would that play out? Would it be a smart move to risk getting more boomers for the chance of appealing or are the TI prospects, even if its clear Chupp fucked it up, not worth the effort? The reposting of the same shit over and over is tedious - I just want to know what are the likely avenues forward and how Vic is liable to approach them. The general consensus that Chupp just doesn't want to deal with this shit and made his own mistakes only matters if that shit is worth appealing, if it isn't then its a whole lot of nothing since the case will retain Chupp as a judge going forward and we all have plenty more time to learn how bright he really is.

It's hard to tell in the "fog of war." I'd want to see a transcript or a more coherent explanation of what happened. If the judge actually did consider the Slatosch and Mignogna affidavits and still threw out the TI claims, he's off his rocker. If he thinks Vic has to demonstrate damages at this stage, he's also off his rocker, but we haven't seen that he does.

When, and under what circumstances, can Vic appeal the decisions made today and how would that play out?

He has to get permission to appeal it from the appeals court. The other side automatically has the right to appeal.
