The way I see it, there are 3 scenarios as to what the fuck happened today
1: Chupp is just a moron, and simply doesn't understand the TCPA and the difference between "clear and specific" and "preponderance"
2: Chupp decided that he was going to throw the case out before today even rolled around, struck everything as soon as it came up, got to defamation and realized it was more solid than he anticipated, and is taking his time to strike it within the 30 days but make it harder to appeal
3: Chupp is striking parts while planning to let defamation go through so that neither side can appeal it until after it all finishes
4. Chupp is terrified of Ron for his past threats against a judge. ;)

I'd say two just because of Lemonparty's 500 page mess and then Ty's 1,200 page spergings. Imagine wanting to deal with a year or more of that shit.
 
Didn’t somebody say Chupp was pissed because of all the filings? Guess he really does get agitated when people waste his time.

Considering out of the 4 lawyers involved, he treated Ty and Lemoine the most poorly while favoring Sam (who has been sitting quietly the whole time), that should say all we need to know.

Chupp doesn't seem to like to be told how to do his job, and seemed to retaliate against the two lawyers who have been trying to tell him how to do it

Probably number 2. MoRonica's TCPA filing was highly prejudicial, and the judge may have just ran with that initial impression. All the sperging out in pre-trial stuff doesn't help any, either.

I know I would be. It actually seems like Chupp wanted a TL;DR from Ty and Ty couldn't give him one. I mean, with almost as many pages as War and Peace you think you would have everything to make this open and shut.
Chupp may be doing some weird calls with this but I don't think Ty should have just fell into Lemoine's slap-fight. Chupp might just see them both as retards at this point. which makes sense why he would want to just make this a defamation case. Two idiots yelling at each other may describe what he sees more than a professional lawyer helping a contractor prove that his business was illegally interfered with.

I think it was due to Lemonie and Ty both using the court as a way to attack shit that pissed Chupp of the most, Sam just treated it like a normal case and a test for a defense he tried to see the legal theory of in the past if I remember right.

I've been reminding myself all along of this: simply filing the lawsuit was the victory.

Even if Vic loses everything and has to pay court costs (the sting of which I hope the GFM will reduce), the fact that cancel culture was challenged and people were put on notice that they can't defame people without the risk of a crowdfunded backlash of litigation was the lesson.

Even if they lose no money, those sued had to spend time and energy on the hassle, the worry, and the humiliation (e.g. Toye the wifebeater's shameful past).

Any victories Vic would have or will have are just bonuses.
 
If he actually said that in those words that could be appealable just by itself.

He didn't say that in those words, but that was the level of evidence he expected.
 
So much for all of Nicks judge predictions. The amount of times he talked about the opposing team reading the judge wrong or said "If you think Chupp yatta yatta..." is embarrassing. It all amounted to a big wet fart.

What the hell are you talking about? Nick and Ty were both clear about how they couldn't say for certain how Chupp would be, or how the case would go in general. They gave palpable odds for Marchi's TCPA actually succeeding-- much more than ISVW and even much of KF would. Nick just happened to be consistently right about everything important up until now, and even up until now, he was right to worry about Ty's recent mess ups-- which Ty acknowledged.
 
OK. So it seems pretty confirmed that this judge was a combination of lazy/incompetent. It was mentioned that all the filings for that day got cancelled except just the Vic Mignogna stuff. So it's not like he was crazy busy. I'm done with this thread for now. I was willing to wait and see while commenting on the sideline, but this has the potential to legitimately piss me off if I see any more of this garbage.

EDIT: I just realized this happened on a Friday. He probably wanted to get started on weekend fun.
