To be fair, you can conduct limited discovery of it's relevant to the TCPA itself.

That could be an admonishment of Chupp to Ty about why Ty didn't subpoena some of the convention owners that dropped Vic.
True, but at the same time Ty indirectly show'd that they never had enough time to do anything besides go through what, like 1.5K-2K pages of doc's.
Personally (based on Chupps handling prior and now) it showed that Chupp wanted a higher standard when you realize that many points of TCPA the defendants filed shouldn't even be there, and that he only stuck 1 filing (Ty's) September 2nd.
Even if Ty realized that Chupp wouldn't be following Statue rule's, he would've only realized that last minute leaving him little to no room to adjust.
The other issue comes from the fact that the defendants where constantly adding, arguing, or trying to prevent Ty from focusing on the TCPA dockets at hand, and Chupp did nothing about it. Not a judge, nor lawyer, but it just seems like the judge didn't even bother presiding over the baby factory and just allowed them to do w/e they wanted.


I am curious if Ty's supplement filings was even allowed, Funi is trying to argue it's not, but is it?
Also is the first set of affidavits even a thing legally anymore?
 
The worst thing about this is the KV arrogance running rampant now. And within a month, we could see Vic on the road to a Stalin job. Here’s hoping the Funimation shit isn’t forgotten like most internet drama. But it will.

The way I see it, there are 3 scenarios as to what the fuck happened today
1: Chupp is just a moron, and simply doesn't understand the TCPA and the difference between "clear and specific" and "preponderance"
2: Chupp decided that he was going to throw the case out before today even rolled around, struck everything as soon as it came up, got to defamation and realized it was more solid than he anticipated, and is taking his time to strike it within the 30 days but make it harder to appeal
3: Chupp is striking parts while planning to let defamation go through so that neither side can appeal it until after it all finishes

And this guy was elected, you say?


Why does Chupp sound like got out of bed only to realize that someone broke into his house and replaced his flooring with Lego?

This is some serious "taxation really is theft" kind of stuff... now I'm curious as to what Chupp's reputation was before this lawsuit was assigned to him.
 
What the hell are you talking about? Nick and Ty were both clear about how they couldn't say for certain how Chupp would be, or how the case would go in general. They gave palpable odds for Marchi's TCPA actually succeeding-- much more than ISVW and even much of KF would. Nick just happened to be consistently right about everything important up until now, and even up until now, he was right to worry about Ty's recent mess ups-- which Ty acknowledged.
I don't care how many times he said he wasn't sure of this or that in order to cover his boomer shorts wearing ass because he also constantly said how the opposite side was reading the judge wrong. I've heard him say "If you think Chupp..." this and that so many times that its burned into memory. That's all I'm pointing out. I just think it's funny he read him wrong too despite talking about the others doing it wrong so often.

Well that's a rather ridiculous way to determine it. By that reasoning, any politician or corporation which is major within it's niche could defame a private citizen; and when the court had a bunch of people there because it was a politician or a corporation major within it's niche being sued, the private citizen would somehow be a limited purpose public figure because a bunch of people familiar with their defamers showed up.

Yes, its the most appeal-able thing he's done, thats obviously crap. Vic hasn't thrust himself into a public controversy, and definitely hadn't done so before the defamation began.

He probably saw the writing on the wall the minute Ty fucked up on the deadline.

I think he was just managing expectations ahead of judgement day, Nick has always said this lawsuit is not a sure thing
 
I swear to God I hope ty goes scorched earth on this motherfucker. God damn that pisses me off that this fucking judge isn't even interested in this case and instead of using the law to decide it. Fuck this guy.

have to wait for the transcript but oh man, ty saying "we’ve met the prima facie minimum," and Chupp saying no is pretty embarrassing.
