Something's up with this judge. Didn't the defendant's lie to him that they said they wouldn't post depositions online to further defame Vic? Also that THEY have been rather exceptionally late themselves and for a longer period of time? Did he forget that?Apparently the amended filing was thrown out and he MAY use the affidavits.
He basically came off as requiring more then what was originally needed.
Also there is some issue's with regards to Rule 11, this Rule 63, Rule 53? and how amended motions works. They where arguing that adding ANYTHING to an amended motion, even if it was switching a sworn affidavit with unsworn ones where allowed or not, witch basically means adding linked tweets wouldn't be allowed even though it would be apart of the original tweet.
Also there was an issue with their original filing being allowed or not because it was file "late" due to technical difficulty and Rule 11 conflicts.
Some guy only got bit's and pieces, some may be off but that seems to be the jist of it.
If he's not allowing technical difficulties but some how allowed the defendants party to use other rules outside of the rule 11 agreement, makes you wonder how exceptional that court is going to be in the follow months assuming he doesn't dismiss everything else because of the Rule 11 issue and lack of evidence.
