All's fair in spergs and war, I suppose. Hopefully the TI can be appealed (it seems like the strongest appeal to follow if they decide to).

The "funny" thing is Chupp used a "full" or "increased" count of people in the court room to rule a limited public figure statues on Vice, or at least LPPF (w/e that is).

Apparently the amended filing was thrown out and he MAY use the affidavits.
He basically came off as requiring more then what was originally needed.
Also there is some issue's with regards to Rule 11, this Rule 63, Rule 53? and how amended motions works. They where arguing that adding ANYTHING to an amended motion, even if it was switching a sworn affidavit with unsworn ones where allowed or not, witch basically means adding linked tweets wouldn't be allowed even though it would be apart of the original tweet.
Also there was an issue with their original filing being allowed or not because it was file "late" due to technical difficulty and Rule 11 conflicts.
Some guy only got bit's and pieces, some may be off but that seems to be the jist of it.

If he's not allowing technical difficulties but some how allowed the defendants party to use other rules outside of the rule 11 agreement, makes you wonder how exceptional that court is going to be in the follow months assuming he doesn't dismiss everything else because of the Rule 11 issue and lack of evidence.

Something's up with this judge. Didn't the defendant's lie to him that they said they wouldn't post depositions online to further defame Vic? Also that THEY have been rather exceptionally late themselves and for a longer period of time? Did he forget that?

Not agreeing w/ gayops but agreeing that the defendants did some goofy shit along the way. Marchi denying getting papers, posting shit online, Toye blatantly starting shit, nobody complying with discovery.

But it may be for the best. This might do better without Chupp. Or maybe I'm being too optimistic and trying to validate Vic's case.
 
Can somebody explain in a few words how U.S. judges are being elected in Texas? What is the procedure, who decides it?
 
While it is odd that the cause of action which arguably had the strongest evidence (TI) got thrown out, the defense lawyers probably would've preferred that the defamation cause be dismissed, as (I believe) that's the one for which higher damages can be awarded to Vic.
Once the ruling is filed, the discovery stay ends, and Ty can take MoRon and Funimation to task for their lack of production.
They won't be able to hide behind the TCPA anymore.

I mean, if Chupp takes a TCPA hearing and forgets what it entails so badly that a KV paralegal is going "WTF?", then yeah, maybe a different judge would be for the best. Still wish Marchi was on the list. Maybe that can change.

Marchi isn't in the clear yet. She'll eat her just desserts in some way.
But even if not, I wouldn't be surprised if she buried herself by attempting to throw everyone else under the bus to keep herself from having to take responsibility.

Marchi, Rial, Shane, and pretty much anyone else who said "If you don't support us your not true anime fans" has done more damage to the anime community than the actual case has. I am really interested if Nick does have way more information on Funimation and decides to do a Nagasaki show.

How does anyone-- and will you archive this-- how does anyone look at this and think "oh, yeah, these people are genuine, these people aren't just ironically terrible actors that don't realize that not crappy people don't act this way or say/post things like this"?

TI is out altogether because Chupp wanted at least two provable instances of TI.

Defamation is potentially binding on Rial+Toye, Funimation.
Conspiracy potentially binding on Rial+Toye (honestly this might just be because they're in a relationship).

I mean, if things had gone the other way and Chupp immediately granted half of the charges and had mean words for the defendants, it wouldn't be over either. They'd be looking to appeal it as well. I'm still interested to see what Nick says, and what the next filings are, since most reports came from biased kickvic sources.

I know people have stories. The anime community who actually support them through purchases and long term support don't support the woke opinions for the most part.

I look back at how tumultuous Star Wars' fandom has been for reference. A lot of parallels. Hell, a lot of the same people too. Relying on the woke crowd to keep them afloat is going to end in misery because no one woke is about to drop tons of cash on collecting merch, attending cons, and investing in releases and official outlets.

The woke crowd are notorious pirates and fringe supporters. Too self absorbed to devote themselves like their beloved "incels" would.
