Guys and gals I am sorry for acting like this. I think i went from denial, anger, depression, skipped bargaining, back to anger, and now im just accepting that vic has had his chances shot from a lazy judge. Right now part of me knows that I am being unreasonable, but the other part of me wants it all to burn down. Just burn it, salt the earth, and then piss on it for good measure. I should probably go to other boards besides weeb wars and rethink so I stop sperging for a case I emotionally invested in.

If it's as extreme as portrayed it is less worrisome than if he actually based it on solid reasoning. People need to just calm the fuck down and cope. Seething isn't going to help anything.

Standard of review on appeal is de novo which means the trial court's opinion gets no deference. All the appeals court has to do to reverse him is disagree with his opinion.

I appreciate the optimism and that slimmer hope. Not being a sarcastic asshole either. Still I think i am gonna back off till at least monday here.

After reading through some twitter spergdom of a specific Sheriff (who picks up dogshit for a living at the hearing) to doxx some idiot, I noticed there is some inconsistency with John Chupp. He's given the defendants all the time and space in the world but BHBH never really gets a chance, even after a legitimate argument, even with Lemoine moving the goal post right before the hearing. Seems like he's arguing pedantics to throw the case.

To be fair, Chupp was as abrupt with Ty as he was with Lemoine. From all accounts, he was much more cordial with Volney and Sam.

And from all we know, Ty and Lemoine have been the most thorough out of the lot, but also have been the two that have been warring over definitions of law.

We will see in 30 days or less if Chupp is phoning this case in, or if he's sending Ty and Jayshaun a message.

If there's already three complaints about him for this shit publicly, there's prob a few more privately. So, appeal and try to get a new judge?

Some of the points Chupp brought up had merit, in a trial setting. However, he seemed to hand-wave the fact this was a TCPA hearing and already had the opinion that Ty entered into it without having enough evidence, so he punished him for it. Whether that was proper or not is up for debate.

Hard to criticize Ty for not having a preponderance of the evidence and having his case ready for trial at TCPA, but nothing about this case has been simple so far, so maybe he should have expected it.

If I was any of the counsel (IANAL), logically I would not risk appeal and just change my strategy, knowing the quirks of this specific Judge.

He's quirky for both sides, as he's demonstrated. No sense in going fresh into a new Judge and risking that he's not impressed with the fact that you petitioned for a new Judge cause you couldn't handle the previous one.

That's not how it's going to work. Watch marchi and Twitter speds spin it that the reason why marchi got her case dismissed is because Vic actually is a pedo rapist and 'it can't be defamation if it's true'.

But then again, marchi really only had one issue with vic and that was that he pulled her hair.

The reason why this happened is because they abused Discovery and they KNOW it. Vic was too fucking stupid and gave them some slack in the rope to breathe. This was his own fault for not going scorched Earth and Ty's fault for relying on the default of good will.

Seems that a lot of minor details were overlooked, but that's how things go. It seems that the one area you fail to cover will be the hole that sinks the ship.

Well, after a long day of analysis on this, I'm packing it in for the night. Hoping the official transcripts will be made available soon so I can have something to read in the bathroom.
