If a 5 year old had sex with an unconscious adult, which one would be considered the rapist? Neither of them could legally consent, but sex would still have occurred.

It's a fucked up five year old who's probably been raped, yeah. But that's not the point. The point is: who's legally responsible? Is the unconscious guy a kiddy diddler and the kid a victim, or is the kid a rapist and the adult a victim of a weird little psycho? Or are they both victims? Being a past rape victim shouldn't excuse the kid's actions imo.assuming that the five year old would even have sex in the first place without being under the influence of previous sexual assault or rape experiences.

The kid is the rapist because if the guy is dead (assuming if he's unconscious as in legit dead and not just knocked out), not only is it a rapist, it's a necrophiliac too.
