oh how :optimistic: of you. There has been one constant throughout this entire saga. There is never a "downtime" in this case. We should have had several downtime periods already. Every single time the KV crew find ways to pour jet fuel on the trashfire. It is like a reverse law of entropy and they make sure that if it should slow down, it won't.

Just yesterday we had gayops afoot. If the case itself has a mandatory slow down thots will take up the mantle of retardation to fuel the fire. Now some thing will happen today with BHBH.

Turns out the thing that happened today was Chupp ordering the parties into mediation. Either they resolve their issues by October 3rd, or he rules the day after.

Now this is just me reading between the lines, but it sure as hell sounds like Chupp has already written his ruling and is giving everybody one last chance to resolve things before he releases it.

To the legal people here, how abnormal is that? I’m a goon who follows insane lawsuits as a hobby, but I’ve never heard anti1SLAPP/TCPA and mediation in the same sentence.

If Chupp is ordering mediation, that seems to imply pretty heavily that the defamation charges are not going to be dismissed. Why force somebody to mediate an issue you intend to throw out?
Could be he wants to see the case over with and out of his hair posthaste, instead of dealing with interlocutory appeals and regular appeals and the further waste of time and money associated with them.

Could be he's giving them one last chance to settle this outside the limelight. Could be any number of things.

In any case, it's certainly a strange and unusual move.

My thoughts exactly.

It seems impossible to argue on one hand you should mediate, and then backtrack and say there is nothing to mediate (aka decide on) for TCPA purposes. Seems like a good sign for Vic.

But at this stage it is.... bizarre. I see why nick was confused by it.

I don't see this happening.

On one hand Lemoine, Mr "TCPA expert", who is well known to be clear, consice and can take hard decisions in his disfavour, asked to work as if his clients were guilty for a minute to help mediation?

And on the other side, Ty Beard, who has been confronted by a condensed Lawtwiter avatar in mwhaaa form, having to come to a common ground with him?

I still think Chupp is gonna go in favor of the defense. I want to believe Vic will get out of this on top but I just feel it deep down.

I want to be hopeful but I feel like this is a move to see what happens.

Or Chupp went galaxy brain and wants to see if Rial and Toye will go full meltdown mode and set this up for the specific purpose of observing what each party does.

Edit: I also think Chupp is allergic to doing his fucking job but I'm trying not to be critical of him or anyone really at this stage. But I'm gonna hold my breath. My faith in him is pretty low but I don't wanna look at this from rose-tinted glasses.
