Maybe things in the US are done differently but I'm pretty sure to set up a fund like that you have to have some kind of official declaration and record of the money and where it was spent and seeing as its a charitable fund that should be open access? Are there any American or legal kiwis that are clued up on the matter? Because to me, it seems a lot like a hillbilly tax dodge.

Edit: I'm willing to deep dive into the legality of this myself but I'm a brit who lives in Tokyo and I can't even load up the obit posted in post #39. If somebody can access the obit and see if they can get hold of a link to the memorial fund I'd greatly appreciate.

No, a memorial fund is just a fancy way of giving money to the family. It's just a separate bank account, often linked to an existing account, and the bank keeps track of donations. There are no legal parameters on what it can be used for; lots of times (in non trash famblies) it goes toward funeral expenses, a spouse's lost wages or into kids' college funds. It's considered a personal gift and no tax, same as if someone handed cash to Misty.
