I dont see how this mediation could possibly be settled without going to Chupp to settle.

Vic will want all parties to retract statements that were malicious and damaging, public apologies, and for Funimation to rehire him.

Funi might, might agree and settle everything right there, but there is a 0% chance the other fucking morons will even agree to retract their statements, let alone apologize.
 
Chupp asked all the parties (including Marchi) to sort it out throught mediation before October the 3rd.
And now we're trying to guess the implications of that move.


Oh god... We will witness a CalArt version of RWBY, won't we? Why? Just why?
CalArts RWBY would at least have good animation despite the severe artstyle downgrade.:lit::lit:

One thing to keep in mind is that retweets count towards that number. 8k is still a fuck of a lot, but its not him writing 160 character posts each time.
If a client of Greg's (lol) found that they were being billed during his tweeting spergs, could they sue for malpractice?
 
So, let's pretend Marchi's telling the truth about talking to Chupp. Would that even be ethical? A judge telling a defendant: "Don't worry sweetie, everything's dismissed for you anyway." ?

Also the "death threat" thing. Marchi apparently showed these "threats" to the judge. Again, ethical? Not to mention that the person who made these "threats" was some complete random spergy troll who wasn't even a Vic supporter, as others have pointed out.

Since we're on the topic of threats, is it okay for Ty to show these threats to the judge?

guess you could argue Marchi is fine with threats being made towards Vic. I mean, she did already threaten him after all.

yeah, I know those aren't actual threats, but neither was the tweet to the judge. You get the idea. The hypocrisy is astounding me once more.
Jamie is just super duper determined to bias the judge so they can get another one. I guess she didn't like Chupp's careless dismissal of her case.

Seriously, though. Marchi's take of "EVERYTHING I SAID IS OKAY" based off of Sam literally convincing Chupp through clever trickery that Marchi just never says Vic's name is so stupid. She names Vic MANY TIMES. She wasn't given the go-ahead, she was just given a smart enough lawyer to squeeze her through on a technicality. That won't work twice. (That is, on any future lawsuits they brought against her, even if mediation/tcpa/appeals didn't keep her in because they all stick to the technicality)

They sure could, but that assumes T. Greg actually has paying clients and not some poor sap he's working pro bono for who expected they'd get a guy way better than a public defender.
 
So basically, when Lemoine calls himself a 'TCPA expert', what he means is that he has a few connections in the media, so he can float defamation into journalistic shields, when his clients originally couldn't even get it off the ground. "Don't worry, guys, I'll get a bunch of media on it so we can pretend he's a public figure, and if that fails I'm sure I can bias the judge or poison the jury!"
 
Okay so to summarize what we know about the mediation.

All parties are included, Marchi is there because her TCPA may be dismissed or because some reason we don't know, on the legal thread someone mentioned that since TCPA payments are awarded by the court they could not use mediation to negotiate those payments.

The mediation has a very short window of opportunity to be done, unless they can make some type of long distance meeting, they either have 2 days from now or 2 or 3 days before the limit date.

The mediator seems to be skilled at mediation, this according to previous reviews.

Also one last tidbit, case law indicates that if Chupp does not officially write up his rulings of the TCPA before the limit date then the TCPA is dismised and if I remember correctly the defendants can't appeal, so Chupp could also be trying to save face by forcing a settlement with mediation and if that doesn't work then he could just not write his rulings forcing the case to move forward and stopping any appeals, this would be morally reprehensible, but hilarious and may also be a smart move fr Chupp since he doesn't get reprimanded by an appeals board.

The last point is also very much unlikely so I don't think it would happen, but if anyone who knows about law can give their opinion on whether Chupp could do something like that I would appreciate it, even if all you do is say that the idea is stupid and Chupp can't do it because so and so.
