My read on the situation is that Chupp sees the appeals process as inevitable given his prior bench rulings, and he hints he thinks the appeal probably will succeed to get most of the causes of action at least past the TCPA level, given his comments to Sam Johnson.

Opinion seconded. That would suggest he's pretty set on dismissing Marchi wholesale himself, though. And that, in fact, he's trying to be set in his rulings overall such that a motion to reconsider will likely not accomplish anything.

It's odd, though. He speaks of appeal as if it's a definite thing, but the further implication is that appeal would possibly be granted. He obviously couldn't manage a way to make his rulings appeal-proof, and rightly so-- the hearing was a mess from the bottom up (that he phrases this as being part of the standard back-and-forth between him and the appellate appears disingenuous, from my perspective). But if that's the case, why wouldn't he be open to reconsider upon motion to do so?

Probably has to do with the fact that the hearing was altogether defective.

So, I'm pretty sure the death threats were a pretense. He really did catch word that the appellate court authorized sodomy against judges whose decisions they had to kick back because of their exceptionalism.

Honestly, Chupp should just stop fucking around. He's going to be stuck with this case whether he likes it or not, and he just needs to just bite into the shit sandwich. Kicking the can to the appeals court is just delaying the inevitable, unless he's secretly hoping that Vic and his legion of autistic paypiggies can't afford an appeal.

Hrm. It appears Douchette saved the pdfs as watermarked images, unlike the TCPA hearing transcripts which were text.

To remove them you'd have to edit each page in Gimp or whatever. Or maybe I'm a potato and doing this entirely wrong.

The main problem is that it's very, very unlikely this won't get appealed at this point, no matter what he rules. The whole process has been jacked enough that both sides have legitimate cause to appeal. Simply put, he fucked up and he knows it.

I almost wonder if he's trying to use the "threats to his life" bit as a way to recuse himself so he can get himself out of dealing with this.

This is one possibility I am also considering. He will save himself a months-long headache, but whoever picks up the case after him will hate him for it.
 
I could attempt to guess what will happen going forward but this case has shown time an again that trying to predict it is a Sisyphean task.

Man what a waste of time and money. He couldn't just email them? There was maybe a page or two of text, that's like maybe a two-minute discussion if that. You would think he would give them some kind of firm instructions or something. What possible incentive could there be now over and above whatever has happened throughout the last 8 months? I think everything Chupp does needs to be looked at only through a Public Relations tinted lens. I don't think he gives a fuck about anything other than his public appearance.

From Chupp's non-internet literate perspective (which anyone who puts any kind of weight to an anonymous online "threat" has to be) this case would look like the defendants have overwhelming support. The only media reports have been heavily biased towards them and is leaning on the MeToo theme. Going against that narrative is political suicide in 'current year'.

I fucking hate to say this, but the optics on Chupp giving the horrid "rapist" one last chance to just apologize and let it go would play quite well on the Dallas 6 o'clock news. Even after months of death threats from the angry incels incited by Vic and his legal team towards these defenceless waifs, going so far as to "threaten" the courts! He gave Vic one last chance, to repent and help "heal the community" before finally slamming the gavel down on this evil man. That looks damn good to the voting public, who is paying even less attention to the facts than KickVic is.

Appeals be damned. Chupp knows full well they're gonna happen anyways and hopefully, elections are long done by then, or the fire dies down on its own.

I'm not saying this course of action doesn't have flaws, but it certainly has an appealing veneer for an elected official.
