That's not going to happen with everyone there. The Machiavellian genius move would be to make a private settlement with Funimation before the mediation and then drop that on them like a nuke.
I wouldn't trust Ty to pull off that. He has proven himself, beyond any reasonable doubt, to be to smart for his own good. It was his own gaming and Machiavellian plans that fucked his end of that TCPA hearing.
My thoughts,
While it would be best for everyone to stop throwing their money into the bonfire, it ain't gonna happen.
As is, every party of this has the same financial motive to end that any lawsuit has. BUT, and I think those supporting this motive forget this, the financial motive is rarely sufficient on its own. It, especially as a court case drags on, does become a fairly persuasive motivation but people tend to have skin in the game outside of money.
MoRon are hardcore believers, Marchi is do or die for her friend, Funimation is puppeted by a man who personally hates Vic, and Vic himself is in it to get his name cleared which means the others need to fold for his objective to be met.
This means in order for the money motivation to work, their PRIMARY motivation needs to be sufficiently damaged or removed.
So, is any primary motivators damaged?
MoRon - No, just flat no, and frankly I don't see any of them EVER folding. They not only fully believe their own bullshit, they also fully believe (AND NEED as an important note) the TCPA to win in appeal. Money is the OPPOSITE motivator for them, as they have been burning it hard.
Marchi - Do or die with her friends, and is out for all intents and purposes. Literally no motivator just like MoRon, neither primary nor monetary.
Funimation -Pooossibly. None of us know, or will know, if Toei has made its displeasure known for the tapes. Nor would we know any pressure that may be coming from Sony. If none or low, then Funimation has absolutely no reason outside of money, which they have to burn. If yes, then they may be willing to roll over. No way to know as any indicators are done behind closed doors.
Vic - No, just flat no. His primary goal would not be met at all here, he has the GoFundMe to help funds, and a fairly lucrative career on the convention circuit to fall back on for savings. Not to mention the TCPA hearing was a farce, so appeals are quite possible.
In summarization, with the POSSIBLE exception of Funimation, no one has any reason to actually settle. Not even monetary.
