Define 'screwed'? It's unlikely that he will lose the lawsuit completely if factoring in appeals. It's somewhat unlikely he will win it completely even if factoring in appeals. The lawsuit is very early on, so it's hard to predict final results.

Vic is the Plaintiff. He is the one suing Funimation, Monica Rial, Ron Toye, and Jamie Marchi (the Defendants) for Defamation, Tortious Interference with Existing Contracts, Tortious Interference with Prospective Business Relations, Civil Conspiracy, and Vicarious Liability.

A negative outcome would be either getting it all tossed on TCPA or the judge/jury determining the defendants did none of those things, in which case he loses out on the money it cost him to run the case, basically.

It's pretty unlikely for a complete defeat though, as there's some uncontrovertable evidence at least some of those causes of action happened for some of the defendants. Most recently he suffered a setback where some of the causes and one of the defendants got out on TCPA (meaning their causes were dismissed and he's expected to pay them back for their trouble) but there are appeals ahead to reconsider that, and he has a pretty strong case for making those. The final ruling hasn't been made (that happens Oct 3rd/4th) and that will determine the remaining causes. Defendants will undoubtedly appeal if it's not all tossed out, Vic will appeal if it is.

Thus, basically nothing of real consequence has actually happened. It's still infant stages of the lawsuit. The law is slow.

Cause pretty sure if you are already a part of a lawsuit of one type, that you could file those "criminal charges" still in a criminal lawsuit... I wonder... why they haven't?
