Now take a guess how many will show up if this entire thing is tossed? Yeah, exactly. Nobody will care this shit's going to appeal, it will be open season on Vic and his alt-right Nazi incel fans. Every garbage journo around the internet will be lining up to lick Sharon Griftsby's rotted taint to get her feminist hot takes about anime's #MeToo moment and probably will get some wonderful quotes from J. Sean and maybe Low T. Dregs too. They'll probably try and get Nick banned from Youtube by running hitpieces on him as the "official lawyer of incels and alt-righters", and I can't wait to see all the articles screaming about how anime fans have a problem with sexism and cite Vic's case as proof. These are common opinions floating around the KickVic corner of Twitter, now just wait for them to get amplified and spread around the internet by the clickbait media. Expect the worse come Chupp's decision.
Except Vic often reaches out to these fans. Fans who are depressed, suicidal, or just want someone to talk to.
I'm starting to think the mediation gambit points toward defamation not being dismissed. Reason being: One of the statutes to try to cut down on frivolous lawsuits is that you can all but self-dismiss a defamation suit by doing the one thing Vic wants, which is retracting the statements with a "my bad" kind of thing. So basically, you (generically as a defendant) can prove no "malice" by saying "I did that, but I didn't know, I know now, my bad let's move on". In the broad sense, it's bad for the person being defamed because the initial claim is usually more noticed than the retraction, but there it is. I think Chupp is giving the defendants in this case all possible attempts to take that "hey, my bad, no harm no foul" clause. And to be totally fair, I feel like if they don't take that, then this shouldn't be an anti-SLAPP thing and we should have a trial to see who's lying. Chupp's conduct and logic were so trash that an appeals court is going to smack Chupp harder than a chinese parent with a failure of a child and make him do the entire thing, skipping TCPA having made the decision for him.
i'm speaking in hyperbole of course, but the reality is still there. Chupp is going to lose appeal regardless of how he rules. I don't have any emotional investment in Vic himself. If the end result is a trial where he's proven guilty, then so be it. My issue is with the rumor-fueled lynch mob. I'm against the standard that someone can be fired and ostracized simply because his accuser is a woman claiming sexual assault. Your job should not be subject to the whims of social media mobs.
