So if I'm reading this right we should expect a notice to appeal before the 24th to the 30th (if counting business days), feel free to correct if I'm wrong. It strikes me as weird we have no word from the plaintiff yet, a strategic silence? Or Vic genuinely wants to move past this lawsuit, which I don't blame him for at all.

It's the 24th because it would be an expedited appeal from the date of the order, which was on the 4th, with the deadline falling 20 days after that.

feel like a fucking crackhead begging for just one more hit of the "sped did a dumb" drug. i need the appeal to happen, and for it to overturn everything just so people lose their shit and i can get my fix.

So back in mid-2016 (archive isn't going through), their license to Fullmetal Alchemist expired--months prior, Brotherhood's license expired--and they didn't renew it and it instead was acquired by Aniplex. This is weird because why would FUNimation not fight to keep one of their most popular IPs? It wasn't like it was losing them money.

Now it's possible this was just foreshadowing of Sony buying out FUNimation, and so they must've known about this merger from back then, but what if they let it expire just because it was a way to slowly phase out Vic? Vic hadn't been getting big roles by then, and his last big project before the Broly movie was directing Zodiac War. The Broly movie kinda came out of left-field, therefore peeving off Chris and others because it meant having to put up with Vic's presence even longer.

Maybe that's something that'd be in discovery if there's any relation, but I always felt like there was something going on behind-the-scenes when it came to that particular decision.

Well remember, Vic had a director job lined up at Funimation sometime around the Broly movie. Funi people slagged him because they didn't want this guy that had been out of their end of the business for a while coming in and just getting a job like that.
 
Honestly I really wanted Jamie to lose. She's makes herself an unlikable person , from her childless tweets and unprofessionalism, to putting in political shit in anime when it wasn't orginally there/needed, to saying who is a real fan or not ( like any va has the power to say who is a real fan or not). I dont think anyone is gonna want to be her fans if she keeps acting like that, let alone work with her

But: Yes, Yes, and No.

1. Appeals seem worthwhile and likely, because of the WARCHEST.
2. Ty done fucked up some. Not as much as Chupp, but timing and formatting problems made it easier for Chupp to counter-sperg.
3. Nick ain't done shit. Not for lack of trying. But I doubt Ty is feeding him anything damning to his own case.

That reminds me. In his depo vic mentioned Daman Mills as one of the Funi VAs that wanted Vic gone from Funimation, and Monica too, obviously.

From my understanding, when Vic directed Zodiac War he hand picked Daman Mills (who played the lead role in the show), and Monica (who was a significant secondary character). This was back in October-December 2017.

So now I'm wondering when this movement to get Vic booted started. If it was earlier than Zodiac War, it'd be weird for Vic to cast two people who hated him in noticeable roles. If it came after, it would mean this push to get him fired wasn't nearly so old as people want us to think.

The third option is Vic cast Mills and Monica to be a magnanimous Christian, but I dunno.

@AnOminous since it would be a 'notice of intent to appeal', is there a possible issue with Vic or Ty or etc announcing they intend to appeal before they file the intent proper?

I'm worried that there's enough "technically ok but odd" things that have been done, like BHBH trying to submit a technically ok to submit second amended filing or the affidavits that weren't then were then weren't again, that the appeals court is going to have difficulty puzzling through things. Chupp chupping up things, seemingly in such a way to make it intentionally hard for the appeals court by not giving any reasonings for anything -- which implies his reasoning was "fuck you this is my court" -- doesn't help.

I hope Vic appeals; I worry about the appeal going through. But if Vic is a public figure then literally everyone is. And if what they did to Vic wasn't Defamation and TI, literally nothing is.

I suspect that if the appeals court gets ahold of it, they're going to slap BHBH around a little bit for odd filings, but hopefully not enough to ruin the appeal or the case. At the same time I suspect they're going to be very upset with Chupp. I hope BHBH is pulling out all the stops on the appeal, including bringing in a specialist.

Edit: As for Nick, not mad at him. I think he's realized that some people want him to be the next Ralph / Andy / Jim etc -- a drama channel, and is trying to pull back from that, since that shit inevitably leads to spergery like the Sweety Squad or Ralph's Gunt Worshipers running around demanding people give attention (and superchats) to their god and their latest crusade to drum up fresh drama for clicks.

Not really but they have no particular reason to want to do it before doing it. It's just a one page notice. I forget whether it has to have a certificate of service, but it goes to the trial court and everyone should get it immediately.

I think this was more "recent" and "opportunistic." Primarily hinging on Michelle Specht.

If they wanted Vic out all this time, they could have done it during the peak of MeToo. When guys like Louis C.K. and Charlie Rose are getting knocked out, no one would raise a question about an anime VA suddenly being exposed. It would have national attention instantly. Instead Andy Signore was the odd dude out amongst the celebrities torn down by MeToo.

Instead they waited until the MeToo movement was down to embers, the best media they can get is the Dallas Morning News Op-Ed.

Vic and Michelle broke up. Either no one wanted to catch Michelle in the cross fire, or more likely she is a particularly vindictive bitch that knows where all Monica, Sabat and Marchi's skeletons are buried and would bring them out. As long as Michelle was around, going after Vic was Mutually Assured Destruction.

Sabat was apparently well on his way to quietly phasing Vic out of the industry. Ethan Stone may have let slip the information about what the TCPA is and Sabat saw a chance to get rid of Vic using MeToo as cover and TCPA as a shield.

I don't know if Vic's even appealing. There's been no indication one way or another. I'm reasonably optimistic should it be appealed and have competent appellate counsel.

While Ty did not confirm an appeal, he said, "Do I look like we're not going to appeal?" and that "No one should bet the rent money against it."

It's not that Funimation didn't want FMA anymore, they just didn't want it at the price it would cost to renew the license.

Vic also said that he wasn't getting as many roles as he thought he should. Vic being up for a director role probably screwed everything up.
