I don't know how many appellate judges there are but it would be even more hilarious if it's the same judges who already overturned Chupp. Chupp's rulings are a comedy of errors and it would be karma to see him slapped down AGAIN by the same people.

This is literally hate speech and I'm reporting you for having different opinions to people who are super lawyers on Twitter.

Seriously though, where did these claims even come from? Attorneys aren't allowed to disclose what they discussed with their clients, so even if these two DID say "nah, you're fucked" there's no way Law Twitter should know about it, right? All Vic seems to have done here is the disgusting practice of... getting multiple opinions before deciding on a law firm.

I find it hard to believe all 3 of them will have the case of the Chupp. That’s going to be 3 judges.

Though I wonder, would it be the same 3 that have appealed a case from him before?

If that’s the case I’d feel sorry for them, they’d probably be like “fml this lazy bastard again?”


I believe there are 7 judges on the court of appeals. 3 will be selected.

I figure Chupp's cases make up a significant portion of the appeal's court docket. At least 3 writs of Mundamus are exceptional enough, but then there are the cases that Chupp managed to only "kinda" fuck up.

Chupp has to have a reputation at this point.

Edit: Appeals court is based out of the "Tim Curry Center." Hell of a name.

The line they tell is basically using Nick's warnings against him. Lawsuits are expensive, and even if you win a defensive lawsuit it can still ruin you by burying you in bills. The idea is that Vic is Scientology, because the GFM money is obviously similar to having billions of dollars to frivolously sue people, and so he's punishing 'survivors' by suing them and using the law to hurt them. The idea is that he was foolish enough not to understand the TCPA, and that this punishment lawsuit is exactly what the TCPA is designed to protect against.

They're going to have some trouble spinning this after TCPA fails, but they'll likely try to run with 'Vic just kept pushing it until he got someone to give him the answer he wanted, it's a miscarriage of justice that it's got this far'. At least until discovery buries the defendants in evidence.

Okay, but that reasoning is still stupid. Their side is talking about buying offices and cars in the middle of a suit. They're the ones that chose not to settle when they had the chance. If they win the only bills they're stuck with is attorney's fees they themselves have ramped up, which the GFM they slabber over could easily cushion greatly. It's just another opportunity for them to play the victim. There's no "burying you in bills" for them unless they flatout lose the case in trial and don't appeal.
 
I think many have visceral racists impulses they are ashamed of and blame society (aka white priviledge / institutional racism) and seek absolution by exacting penance on everyone else.

From what I can tell, it was mostly the two of them searching together, with her helping to find a firm, and him letting her know what they said. Not that she's directly involved with the suit itself, just the initial search before BHBH.
