It's kind of the point of TCPA, in a way. The plaintiff should have all the evidence he needs to make prima facie from the get go, since TCPA freezes discovery, and actually sane defendants would say "no u" and file TCPA right away.

The problem here is that all defendants conducted at least a little discovery against Vic (Johnson and Volney got to depose him for a few minutes) and in at least Johnson's case that discovery was used in their defense.

I don't think the discovery fuckery is in and of itself a good appeal point. It just means they're difficult shits. What's a good point is that all parties conducted discovery against Vic. If you file TCPA (which basically says "why the fuck am I being sued? You have no case"), but then conduct discovery against the plaintiff (which suggests he at least has claim you need evidence to defend against), that should be a big red flag.

EDIT: Nick talked about it briefly. It's an argument, but might not worth it considering timing and word limits.

I think you were in the VC on Nick's Discord when I brought this up last week. There is a case to be made that because the dfeendants--all of them--willingly allowed discovery to proceed and, in fact, took part in the deposition of Vic, that TCPA no longer applied. The letter of the law and the spirit of the law are to dismiss frivolous lawsuits before discovery happens, to minimize the money put forth by all parties involved. By deciding not to file their TCPA right after receiving the notices, one could argue--and I'm upset Ty didn't as it could very well be unappealable--that the defendants forfeited their right to file TCPAs because of this.

FUNimation and Jamie would have the easiest times getting around this by saying that they aren't the ones who forced the deposition of Vic, that MoRon did and they were there because it was going to happen either way. The counter to that is, "Why didn't you file it anyways, rather than take part?"

MoRon would have the toughest. and arguably if the theory were ruled valid. time proving that TCPA still applies. Their defense would likely be that the TRCP allows for them to file a TCPA, and the agreements/judge's order not to file after depositions have gone forward prevented them from doing so. Ty's obvious response is, "You could have filed before any depositions, as the order only said you couldn't file after one we conducted but before the others had happened." Again, it's a long stretch, but it should have been argued, in my opinion, as it's still an appeal point.

Not saying anyone should do this, because I am pretty sure it's illegal, like very ilegal, I'm more interested in how the complaint ethics board would handle an ethics complaint that appears to be true and may have valid complaints to investigate but comes from a falsified party.

This is why I don’t agree with the sentiment of being angry or distrusting of JYB taking over for Vic (at least for one character).

I think you all remember this tweet. He is someone Vic still considers a friend.

Remember Johnny isn’t a Funimation employee. He’s one of the LA ones. Listen, they aren’t fun shoes to be in. But if I was in JYB’s shoes I’d probably do the same.

If my friend unfairly lost his job thanks to a bunch of snakes, then I see already another snake being recast in one of his prominent roles (Qrow), then I’d want to protect my friend’s work the best way I can from being taken over further by other snakes. The best way to do that, audition for the roles yourself and preform that character to the best of your ability and true to the characterization the actor before you had done.

Do we really want a little greaseball like Daman Mills or any of the other ilk to voice Sabo? Hell no. At least for the time being it will be taken care of by someone who is both competent and not a piece of shit.

I cannot claim to know JYB’s mindset—but from my limited interactions with him at conventions I have been at over the years, the way he presents himself online, his level of professionalism...all tells me he’s a decent guy who actually cares about his job.

It sucks for Vic this is happening but I know Vic would rather his roles go to actors who actually care, actually like their fans, and someone he still trusts...then any of the other snakes at Funi.

Actually not, because it explicitly doesn't ask for communications between Ty and Vic, but between other people (including declarants in the case) about Vic. Any such communications unless Ty has known them since before litigation were for the purpose of creating work-product for litigation purposes which is not discoverable.

They want to snuff out those who have been talking to Nick and Ty, not just Huber and Dahlin and Slatosch and the leaker, but also any VA who contacted them, especially if they work at Funimation. If they think it’s going to work, though, they’re in for a rude awakening, because you can bet there’ll be tons of fans supporting these VAs and the PR will be just as bad, maybe even worse than the audio leak fallout.

Based on transcripts, Chupp clearly saw that whatever decision he would make would get appealed by whoever got assblasted by it. He's stuck with this case, and frankly, the fuckwit deserves it.

Vic did say in an email he sent me and in an Unlocked stream he did weeks ago that he had many voice actors secretly supporting him and trying to avoid negative attention. I sure hope these parasites don’t go after JYB, and others on that list because people like him don’t deserve this.
