This seems a tad confusing. The due date to file the appeal was today, but at the same time it's too early because the fees and sanctions haven't been decided? That seems weird. It is like someone can potentially screw the other party over by holding off on the final rulings of a case. It's like attempting to making it unappealable by making sure there isn't a window for them to appeal.

So, does the filing hurt the appeal now? Or does it not? What would have been the best move?

My understanding is that part of the Texas Rules of Civil Procedure have a provision, or whatever, that if you submit a notice that you're going to appeal, then it placeholds your appeal until the time that you're able to appeal.

However, if you straight up filed your appeal, then it could be considered interlocutory and would be improper. Such is the suggestion of the mighty braintrust that are dunking on twitter. They're ignoring the first part while focusing on the second

It consists of four women (Lee Gabriel (Archive), Elizabeth Kerr (Archive), Bonie Sudderth (Archive), Dana Womack (Archive) ), and three men (Dabney Bassel (Archive), Mike Wallach (Archive), Wade Birdwell (Archive) ).

All 7 judges are Republican.

Three judges (Bassel, Wallach, and Womack) took their position in 2019.

Two judges (Gabriel and Sudderth) were appointed by Rick Perry.

Three judges (Wallach, Birdwell, Womack) were appointed by Greg Abbott.

The last two judges (Bassell and Kerr) were elected.

Gabriel and Womack will have to run for reelection in 2020.

Sudderth and Gabriel have rendered a writ of mandamus against Chupp.

Bassel and Wallach ran against Democrat candidates and won (58.3% to 41.7%, and 57.39% to 42.61%, respectively). Kerr defeated Bassel in the Republican primaries. Otherwise, all other judges have run unopposed.

Getting appointed by a Republican means nothing. Look at Chupp, for example! For all we know these people might be RINOs like Doucette!
 
Do we know which judges have dealt with Chupp already?
In Re Salazar had Dauphinot, Garnder, and Meier (Thus no one currently sitting in this court)

In Re Dakota Directional Drilling had Sudderth, Gabriel and a Pittman.

In Re Universal Underwriters was handled by the Supreme Court (at least from what I can tell), so no judge from the 2nd District

Don't know about general appeals.

I don't understand the law here at all though. So, it was wrong for Ty to file it? He should have filed a notice instead? This hurts my brain.

If this appeal gets denied, can Ty file another one?

He filed a notice of appeal, not the appeal itself.

The main argument is that final judgment hasn't been rendered, since they haven't determined sanctions and fees. Thus, any appeal filed would be considered interlocutory and probably be dismissed.

The notice of appeal gets around that by giving Ty a placeholder. If Ty was too early, he just waits until it's timely to file his appeal. If today's date was indeed the deadline, he filed the notice and is safe.

I thought I recalled someone posting the appeals judges before....maybe my Nyquil is kicking in and I'm making up shit in my head.

But this is interesting.
