This just seems like Lemoine is trying to make a whole lot of noise for nothing.
Ty's motion to quash immediately stays whatever it was quashing, until the court rules on it.

The little bit of research I did into records at the appeals court, it seems like the TCPA hearing is Chupp's modus operandi. He ordered a side to pay into the court registry, refused to hear arguments on why what he was asking was in fact impossible and then told them to go get a writ from the appeals court.

In conjunction with the writs of Mundamus and it sounds like Chupp was more of a problem. But I am biased.

Well he has changed the date around it all a few times now. Latest one is 7th of november, which is still not a 30 days notice, which he is supposed to give according to some laws. Again, disclaimer, I am not a lawman, so I don't know how it works if it is 'only' documents. Or if that makes a difference at all.

Have not seen anything from Chupp. I am just imagining him wanting to light everything on fire.

honestly it doesn't matter. Chupp has to wait 30 days to do anything or he could get slapped with sanctions by higher courts for failing to follow procedure more clear than acid.

This dapper chap here is new to me however. Entire list is: Casey, Perez, Lemwah, Mingehull, and HeLLBerG. I mean, I kinda hope he lives up to the name somehow.

Chupp is a dirtbag that doesn't care about anything. Just because I criticize Ty does not mean I think Chupp's competent.

Chupp's probably going to either 1. wave everything through because he doesn't give a shit either way or 2. dismiss everything because he doesn't care either way. He's not biased, I guess he just always wants to take the easy way out.

I realize this isn't how the "law" or "legal profession" works, but I feel like MoRon's claims that they want to see this in court or show off everything to people in court should nullify Anti-SLAPP. The whole point of Anti-SLAPP is to block FRIVOLOUS lawsuits which are purely intended to shut someone up. It should be obvious that Vic is doing this to theoretically clear his name (at least "legally" if not entirely in the public consciousness). It seems like the perfect example case for someone trying to tear down Anti-SLAPP laws in general, since every citizen is guaranteed the right to have the grievance adjudicated by the prevailing judicial authority. If absolutely nothing else, the idea that Vic is trying to silence the corporate entity funimation with the lawsuit, is pretty ludicrous.

Considering the law as written, I'd say its even money on whether the appeal fails, but this whole situation sours my opinion on the anti-SLAPP statutes. This seems like that law is being abused as badly (if not moreso) as was feared of the lawsuits it is designed to stop. (I don't follow the legal profession closely admitedly, did we seriously have a rash of "shut up" lawsuits before Anti-SLAPP? Some of the precedent setting cases prove that it did happen, but was it really that common?) And besides, if the defense lawyers are seriously working under the assumption that they'll get paid on successful Anti-SLAPP (rather than definite client payments) couldn't you just get the same result by filing counter-suit when someone comes after you and awarding attorney fees and such to the "winner"?

But I also wonder how much leeway judges have on sentencing in this kind of matter. This honestly seems like a soap opera that should've gone to small claims court and ended with someone making a big public statement based on the result rather than giant monetary payouts either way.
 
It was the first thing I noticed. It is terrible of me to say, but perhaps he should see a doctor about removing it, and/or check if it is malignant or cancerous.

And now we're back to 1st of November, at that Hilton suites place in Odessa, with the box to have Slatosch show up in person ticked.

Why is he so desperate for this specific date?

Wait...what? So he’s constantly flip-flopping on the dates now? What is going on in that small brain of his?
