Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

This may be a strategic inclusion rather than something he actually expects to get. Judges often get overturned on appeal if they have rubber-stamped a request for attorneys costs (especially if the costs aren't broken down). So, provide a breakdown, and then purposefully show the judge something small he can cross out so he looks like he thoroughly reviewed it (or as padding in case the judge just skims a few percentage points off the top).

i don't think it's a misreading at all. Drunken Bird suggests that this is put in intentionally ASSUMING Chupp will barely read anything so it would be pointed out to him that he should just not grant these mediator fees so that chupp and the appeals court just wave it off.

That seems like a pretty fair read of chupp given that we've seen him do basically this. Aka not read shit.

Exactly. They know Chupp isn't watching, so they're going to try to get away with as much bullshit as possible.

I think its bold to assume Chupp gives enough of a fuck to cross anything.
 
So much for the TCPA cutting lawsuits short before too much time and money is wasted on it. $286k from one defendant.

I know it's padded all to hell and is likely to be reduced, but still: if you take that TCPA justification at face value, it's an utter failure.

In fairness to Volney, he can't very easily ask for more after the initial request, so might as well throw it all in there whether it works or not. Worst case is it gets rejected, best case is you get a few extra shekels in your pocket.
 
Deduct those mediation fee's AND the fee's for the deposition transcript too. They should have file their TCPA immediately, before any deposition was done. What arsewipes!

I'm not so sure the "they could've filed the TCPA right away, so Vic shouldn't have to pay any of this extra stuff" argument is going to fly. Vic doesn't get to dictate what strategy the defendants should've used to defend themselves. That's not saying that Chumpp's going to give them the moon, but if you're expecting everything related to the deposition to get struck, I think you may end up being disappointed. They chose to depose him. Whether Chupp finds the fees reasonable is another thing.

It won't matter much if the appeals court reverses his lazy TCPA ruling, in any case.

Hopefully Vic realizes he was scammed once he sees how much he will have to pay for each party. Extreme net loss.

Beard needs to go pro bono for this case and just give the whole gofundme to go towards Vics true legal fees. Beard flopped so hard because he took a case in which he didn't specialize in. It was never a good case to begin with but Ty made so many mistakes it is cringe.
