Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

So the filing is exceptional on the part of Sam Johnson. Not sure how many people are left to not have exceptional moments in this case.
Exceptional displays by:
  • Monica Rial: Overall exceptional, especially on Twitter
  • Ron Toye: Overall exceptional, especially on Twitter, and in deposition
  • Jamie Marchi: Overall exceptional, especially on Twitter, and in deposition
  • Nick Rekieta: Exceptionally smug, "Damnit Nick we lost the case again"
  • Ty Bead: Exceptionally smug, "Damnit Nick we lost the case again" and in filing the massive document last minute that clearly needed some polish
  • Andrea Perez: Bringing in Lemonie [source]
  • J. Sean Lemonie: TCPA blogger, exceptional filings, mosquito lover
  • Sam Johnson: Exceptionally filing for sanctions and fees
People who avoided staring into the abyss:
  • Vic Mignogna: Just wants to get paid doing what he loves. Does wear exceptional pants.
  • John Volney: Funimation's lawyer
  • Casey Erick: Another lawyer for team MoRon*
*Want to say Casey had some other exceptional moments but cannot think of an instance.

This is just the list of those directly involved with the case (counting Nick because of running the GFM). There are plenty of others who injected themselves into this like the shoe connoisseur, threadnought people, and the Dallas Morning News writer. All who have shown their exceptional nature. This case is either infecting people with exceptionalism or bringing their unseen exceptionalism to light.

Ahem..."Objection to form" x for all those hours

I found this under Lemwah's billing
I never remebered when he joined, but it appears it was late April. Also once again, he remembers to redact.
Unless there are names like Slatosch or Hansell included, then he doesn't. Very professional of him.

EAM stands for Ethan A. Minshull btw. A little surprised really since I haven't seen his name on any of those lawpapers but....well.

If you scroll down for his non-specific billing and shit:

EAM still is Ethan Minshull. There are billing before june, but no reductions before June...
That is a godawful lot of lawyers for such a case if I be honest.

This part of Lemonfuhrer's filing is being passed around like some kind of slam dunk by KickVic types.

It's kind of sad.

Lemoine’s playing the crowd, just like Ty. Ty’s goal has always been to restore Vic’s reputation and career and the lawsuit was just one of his tools, along with public statements, negotiations, etc.

But the fact that such a blantantly misleading quote is still being paraded around really hurts my soul. Lemoine is an unethical piece of trash, but he’s advocating for his clients to the fullest extent he can. Again, not unlike Ty.

It’s just that those clients’ sole objective is to destroy Vic, truth be damned.

You know lawyers, though.
They'll try to take any tactic to discredit the opposition.
Just depends on how much of a tard the judge/jury are.
More than anything Lazy judges and jurors want simple, easy to understand, narratives.

Trying to explain why it’s sinister for someone to wear a shirt saying we lost the case again, (person not party to the lawsuit) is convoluted and will not translate to people not watching in real time.

List of new filings:
1. An Lee Hsu filed a Notice of Hearing on Plaintiff’s Motion for Sanctions
2. Christian A. Orozco, one of Funimation's lawyers, filed A Notice of Hearing for Defendant Funimation Productions, LLC’s “Motion for Reasonable Attorney’s Fees, Costs and Sanctions”
3. Samuel H. Johnson filed a Notice of Hearing for Defendant Jamie Marchi’s Motion to Determine Sanctions and Attorney’s Fees
4. J. Sean Lemoine filed a Reply in Support of Motion to Compel Deposition and Documents of Chris Slatosch

That was also the guy that sent the twitter "death threats" to Chump. The ones where he said the justice system failed us and we need to get our rifles or some shit. Funny thing is, I think he admitted to being neither ISWV nor KV and that he thought both sides were "r.etarded". Will try to find screenshots. He's a troll and on nobody's side.
Here are the screenshots.

Here are the original "threats" and some ISWV spergs denouncing him for "threatening" the judge.

The Kiwis who just want to watch the world burn are getting their wish it seems.

Marchi has now admitted KickVic has damaged her and I bet Rial's in the same boat.

This shit's going scorched earth.

I hope they keep at them. Court or not they're getting fucked. Hope to see them Gawkered no matter how much fake news propaganda garbage they spew.

So, does Ty have to file now an opposition to most of those fees for irrelevance (since it appears they're billing everything, even stuff that's unrelated to the TCPA like the mediation and the depositions), or does he jave to hope Chupp ain't braindead and actually have someone go comb through all those claims and remove the superfluous ones?

They have to do it to preserve the issue for appeal, although TCPA appeal procedure is apparently much more forgiving of failure to raise issues below, for obvious reasons. Still, they'd best raise the issues.

Also in asking for the mediation to be covered, they're asking Chupp to violate his own order that all parties bear their own costs, even though I suspect Chupp couldn't order such a thing in a TCPA context anyway.

I genuinely dislike Lemwah's filings.
This is what he says is in there:

What is really in there:

Page 2-3: Appearances
SUDDENLY
HERE
Page 93-97. With highlight for convenience. Which is good, Chupp is bad at reading. We all know this
Page 155-156: Starts in the middle of something on page 155, which removes context.
Page 157: Court reporters certificate.

Example from page 95 which is not supposed to be there, but somehow is?

How does Doucette come into 1170 Moolahs?

Lemwah, how much damage did that mosquito do to you?
Why, oh WHY could he have breached the contract. It is almost as if your clients contacted him and encouraged it.
Almost like he has text-messages proving it.....

lets see if we can find why; cause we have the ability to read

Slatosch affidavit

By the way Lemwah, this is from your earlier filing of wanting to depose slatosch....Hows that reading going?

Oh look at that, you can just let the COA know about the pending attorneys fees, and they accept it.

It's almost as if Lemoine was full of shit...

Also, judging by that last checkmark, looks like Ty won't be pursuing that possible constitutional challenge he mentioned a few months back on Nick's stream. Oh well, straightforward appeal it is.

Edit: Even though Chupp completely screwed it up, BHBH doesn't think this is an overly complex case.

It really isn’t very complex. The issues are that the judge is a pinhead, the defense’s counsel is headed up by a lunatic that vomits fillings everywhere, and the plaintiff’s counsel got caught in the swamp the other parties shat out/badly misread the judge/made errors during crunch.

I have never seen a court document use a screenshot in the stead of legal argument before. I've heard of some court documents using them inline to supplement an argument, and I've even heard of some court documents using poems during their initial filings, but never this.
The weirdest I personally encountered was a complaint that included a link to a music track for in the background while reading it... So a screenshot isn't the weirdest thing.

Also new Lawyer! WOO! Taking bets for lawtwitter reactions!

Also in asking for the mediation to be covered, they're asking Chupp to violate his own order that all parties bear their own costs, even though I suspect Chupp couldn't order such a thing in a TCPA context anyway.
The parties split the cost as ordered at the time. Now that Chupp has ruled the case is without merit, it's not really unusual to ask that plaintiff refund the defendants their portion of the fees associated with the case. They did as Chupp ordered at the time, and are saying "Hey, Judge, you ordered we paid these fees for mediation back then, but if you agree this was all bullshit now, shouldn't this be part of the fees we can recover?"

We're getting the very worst that the legal system can offer right here. Now I've been on the wrong end of utterly cucked legal proceedings, where obvious issues were ignored entirely because of convenience and ignorance of the letter of the law, officials threw the weight of statute about to get their way, and bureaucrats revelled in their ability to torment their lessers under the colour of law for petty revenge, so I've been a cynic about the justice system for a long time. The temptation is to follow old Dick's line and kill all the lawyers.

Can it rise above? That's the question. Cynic as I am, and despite the repeated beatings experience has given me over the years in this regard, I have a certain naive hope that it can. :optimistic: has to win out sooner or later.

Wait. Are you saying some impressively exceptional individual actually went ahead and wrote in a fucking internet link to music and told the judge/possibly jury to type that shit into the internet so they can have mood setting ambiance while reading a legal paper they're supposed to react to objectively, aka without a set mood? Oh lordy-loo, what the hell even who the fuck how does this even happen?

I know I shouldn't be entertained by this but, it is rather clear that Sam Johnson and Lemoine somehow worked together on this. Or I should probably say: marchi and MoRonica.
With starting pages like these....

Guess who made which:
One is 77 pages long, the other one 281 pages long.

Eeyh @mindlessobserver made it into the law-papers again

Aw so kind of them to include Vic's Doxx to show them how we were bad and doxed the defendants....and beards army

I am now at page 80 and 95% of this is Nick Rekieta is Vic's lawyer cause they know each other and because Ty handled his relatives will!! (they have thrown in a will, where the guy is buried, a couple of obituaries, what good cause some money went to....)

Page 81-93 are kiwi farm pages, congrats to the people who made it!
If they wanna talk about the entire case being "a game" then how about the hashtags and taunts when Marchi was openly dodging being served? Because if I recall correctly she had a grand ole time being an antagonistic cunt.

thats not actually how that works no.

The plaintiff actually composed the music for that and recorded it herself... I wouldn't be surprised if we get something similar to that in the course of this case though, assuming it gets past appeals. The defendants might not be able to make the music themselves, but I believe they do have connections to people that could do it for them. I mean, I wouldn't expect it, but I doubt anything would surprise me at this point coming from the defendants.

There are a few studio people in this. Brett Weaver does some stuff and Sabat has Oktratron. So it isn't outside the realm of possibilities.
I would love, LOVE, for one of them to just go full out middle-life crisis singer-rockstar period. It would be great!

I am a little surprised they haven't thrown in Vic's musical works though. You'd think with the hate for all he does they'd go for that too.
