How much of what Lemoine is doing is allowed? Like, scumbaggery aside is it technically illegal?
Potentially illegal, but the odds of it being pursued by Chupp seem slim based on previous interactions unless he wises up and realizes the only way to keep paperwork down is to sit up and slap the mosquito fuck down so hard he stops sending him dockets the size of War and Peace.

The discovery stuff is a mixed bag. The Slatosch depo is somewhat frivolous, but that's firmly in a judge's discretion. Could go either way, although 0% chance that Lemoine gets sanctioned over it. The discovery requests aimed at Beard, personally, are nightmare territory problematic for several reasons, some of them bad enough that there is a real chance they are sanctionable. I don't know if Lemoine served the Beard discovery yet, but Martinez Hsu are going to have a heyday bouncing that one out of court.

As far as the bill, that's a huge nothingburger. You guys are just now discovering what lawyers do all day. It's a fucking desk job. We research, we read and summarize shit, we talk highly emotional clients off a cliff. Nothing I've seen so far would be non-billable to a private client, although the judge may quibble about how long things took. I expect the traditional 10-30% haircut off the top, depending on how much of it Beard is able to argue down in a 2-hour hearing.

Lemoine is trying to make the case that Vic knew, at the time he filed the suit, that the texts from Ron were not the proximate cause of Slatosch's breach. That's a stretch, but not a huge one. Slatosch's affidavit says he got the texts, but he also says that he didn't cancel until after other VAs than Monica started dropping out. That's an inroad to arguing that there was an intervening cause. I wouldn't waste my time on it, but if Lemoine wants to that's up to him and the judge. At the very least, it is an unexplored avenue.

"Very frivolous" would be asking for a deposition of Huber. Huber's affidavit didn't really go to any issue that it is worthwhile exploring. The guy didn't know anything relevant to the case, he just knew the people involved and had heard a lot of rumors. Yeah, he made Rial/Toye look like buffoons, but that's not depo worthy.

As far as I remember, BHBH (BHBC now) dealt mainly with estate law. Considering the level of autism involved in all of this, the choice of law firm was....questionable.
I think Ty and his firm should've helped get things started but referred Vic to another firm more suited to dealing with this. There's gotta be better law firms in Texas than BHBC or the two Vic initially talked to for dealing with this sort of case. Hell, Martinez Hsu might've great had they been here earlier, since they do a lot contract law AND Hsu's appeared in front of Judge Chupp before. Or if not them, someone else to do the real work in the case. It seemed strange that BHBH's site updated not long after the lawsuit with Ty's profile there suddenly listing his expertise at defamation and tortious interference.

Someone pointed out that defamation isn't really a lawyer specialty in America. In the UK it is because there is a whole bunch of nuance.

Defamation as a tort is probably straight forward, Chupp just rules like the social security office. You get turned down automatically on the first submission and then you have to appeal to get anywhere.

Also if Vic hired Martinez the reverse could have happened, they could have lost to a judge that BHBH had argued before. If we're going to ruminate about the infinite possibilities we do have to consider that the opposite options may not have produced better results.

It doesn't need to be explored. The judge ruled and settled the matter as far as the court is concerned. All Lemoine should be filing now is a motion for fees and requests for sanctions, not trying to litigate a potential criminal case against Ty and Vic via Slatosch.
