Oh I plan to come March, you see what this little troll that posted the so - called threat that I made on my site didn't post or tell you was that it was actually me threatening to sue the state attorney and the police to get my stuff back, which they've have held for three years, while the investigation regarding the school threat was going on. Those types of threats are legal, I've no threats.
If they don't return my stuff I will sue them in court under 42 USC 1983 and my demands are simple. 1. I want my stuff returned or compensated for it. 2. Since I didn't and there no proof that I posted that threat, which again I didn't post it. I want removed from record. 3. I want a public apology from the police and state attorney, not only to me but my family. 4. I want equal protection under the law (14th amendment) The police has barred me from filing complaints since 2006 and none of this would happened if the police would of been made aware of that site; which was around at that time. By barring me not only did they violate my rights under the 14th amendment but they allowed this to happen. that's it; that's all I'm asking for.

One final note then I'm pretty much done with this place. Your buddy Toad_is_Austic AKA Expose Bad Hams on twitter might be a suspect because he was posting stuff on twitter about me and school shootings 23 days before the threat was posted on the website Hate and Flame, and it is a fact he does post there a lot.

it's not up to the local authorities it will be up to a federal judge. Secondly I not looking for any money, no millions of dollars like many try to get. I want stuff back that was taken under a court search warrant. The court tends to favor those who aren't looking to make money off it so the odds are a little in my favor.

(P.S. grow some hair on your balls and act like an adult, then maybe you will be treated like one.)

Mr. Daugherty,

I do not believe you will be successful if you are suing under 42 USC Section 1983. The law only provides for those injured in an action at law, "suit in equity, or other proper proceeding for redress."

That does not include any lawfully-executed convictions or confiscations. Did you appeal your conviction through your state's state court system?

I was never convicted, The charges were dismissed pending a investigation. The state of Illinois has three years to investigate which ends in march. Now I have been told numerous times by the state attorney that I will get my stuff back after the three years. BUT if it is not then I will file a complaint.

I was innocent and I maintain to this day that I didn't post the treat against the school. I was arrested my name smeared over the newspaper, radio and TV. I spent a month in jail for something I didn't do. I even told the police when I was arrested that no log in was required to post on that site and they didn't even want to go and verify it. It was only after a month in jail that someone was posting on that site as me making more threats, while I was still in jail. that why they dismissed it.
