"read the filing; has researched"

Chupp has fucking stated numerous times on record, he hasn't read things, and hasn't looked at them yet.

In this very hearing, the spednaught reported Chupp saying he doesn't know about some TCPA rules, and needs to look it up.
In the previous hearing he stated he hadn't looked at any of the new filings. What goes on in their minds to have such delusions?

How is it possibly hard to believe? He is a new attorney, on a case he did not follow, that occured only 2 months before the TCPA ruling changed.

There are so many levels of "Ways he missed the TCPA version" here.

1: Thought the case was filed later
2: Thought the TCPA change was earlier
3: Is not familiar with the language of the TCPA and was going off the most recent version.

He made an off-hand comment and was wrong about a version that's difference was a matter of months. Calm your leg down, its jerking is kicking the table.

It's also entirely reasonable to argue one interpretation in one circumstance while arguing another in another, as every other lawyer in the case is doing. The retroactive application of changes to the TCPA is far from crystal clear and he's going to argue for the one most favorable to his client. (It seems pretty likely it's the older version which applies, though.)

Or he could have just got something slightly off in a complicated case. There's a reason for written post-hearing briefs after all.

Something to consider, they asked for a continuance. Reviewing specific dates of when the lawsuit was filed is pretty low on the totem pole of "Things to get caught up on", and they didn't have the two weeks they would have liked to be able to wrap all that up and tighten ship.

What... sleaze? He didn't realize that the case was going off the prior TCPA version. One that came out like.. a couple months after the case was filed, making it a super easy mistake.

That's why he said it's a sleezy mistake IF he did it on purpose, not if it was a mistake. Of course there is probably no way to know. FWIW Beard did know about the changes as he commented on them and their relevance during a previous video.

You are being sleezy... IF your intent is to derail discussion.

See how this goes? Making "Well this is bad IF THIS" is really stupid to do if you don't have a good argument for that what if being true. You lack such an argument, so your comment is just... bad. Unfounded and irrelevant.

I'm not sure what tomorrow is going to hold anymore but I'm not gonna be mad regardless.

I got my enjoyment from today.

I just hope that Chupp doesn't let bullshit happen.

(Edited for clarity, because the Nyquil is kicking in and I'm about to sleep off this flu....)

Oh my bad, I thought the continuance was them having yet ANOTHER hearing 2 weeks from now, instead of just a delay. IMNAL obviously.
Ehhh.... I'd say we are finally able to get to the appeals stage after all the stalling tactics on the defendant side. They can't attack Slatosch, not enough time at this stage. And it's solely Lemoine's own fault on his attempts to scam. Cause he should have known those would be called out.

As much as it pains me to say, we are probably going to enter a lull for a while. This situation has given many a laugh, but eventually it DID have to calm down.

Here's to hoping the Chupp fees ruling causes some massive drama for us to laugh at.
