As a note this was really stupid of Ashli because this means she's got a whole host of problems she could of avoided simply by enduring that 3 hour flight home (and not quickly marrying Richard) despite morning sickness. For one - this means she's on an overstayed visitors visa. That means once she crosses the border or goes through an airport. Her passport will automatically be marked. She's stayed more than one year over her visitor visa so she could be looking at a 10 year block to re-enter the US after. It also means she doesn't really have a path to a green card available via standard procedure because she is here illegally. Her daughter is technically American, so leaving for Canada with the child is it's own legal issue. This also is why her most important paperwork - stuff that she actually needs if she was to apply for greencard - also isn't in her possession. All the easy ways out are blocked outside of lawyers.

Getting a K1 (Fiancee) or CR1 (for people who jumped the gun on marriage) is a slow process pretty much to prevent this sort of impulsive hooking up that leads to unsuccessful marriages. Takes 9-12 months just to get the application processed from the sponsor, then the benefactor has to do medical tests (and pay for them), ensure they have all their shots and attend interviews at their local embassy. You need police certificates, birth certificates and ID for the green card process itself once you get to the US - which is another $1250 and a year long wait in it's own right - until you have that greencard, you also can't work, so you need someone who can support you till you are given employment authorization.

The authorities won't take "I didn't know overstaying was bad" as an excuse and won't take kindly to her asking for help when she's skipped several legal processes that are there to protect immigrants from situations like marrying half-hearted losers who can't be arsed to put effort in to support you in the long run.

If she had gone home, the daughter would have her citizenship automatically by place of birth, they could of applied for the CR1 and had her and child both over legally within a year, and then she could of likely had her greencard by the point that Lowtax decided to grab some mormon pussy in Utah and no problems running for the hills after that.

Granted it probably wouldn't of gotten that far because Lowtax is a lazy wino - but if someone isn't willing to fill out loads of paperwork and endure admin to ensure your own rights are secured and equal to theirs in a foreign nation, you probably shouldn't marry them.

I don’t know how she will fair if she’s trying to use VAWA. It’s a law meant mostly to protect women imported from third world countries (many who don’t speak English well) who got married to abusive shitbags out of desperation and ignorance.

Ashli is from Canada, skipped out on normal immigration process cuz reasons, the relationship goes sour and so her I-130 application stalls out. Her options now running out she now claims VAWA after four years? It’s going to get scrutinized to hell and back and be a nasty ordeal for all.

If she truly wanted to “kidnap” her own daughter she could have legally documented her child as a dual-citizen and then obtained a passport for her daughter via Canada. With her daughters papers in hand she could have gone back to Canada with her while Lowtax is banging the Mormon Wolverine.
