Scenario A:
Bank takes possession of property. Bank takes a loss and doesn't pursue him for the rest. He has to pay taxes on the difference as its deemed income
Yeah, it would be considered forgiven debt. He'd probably walk away with like $10K in additional income taxes in the year it was foreclosed.

Scenario B:
Court looks at his income and says to stop being a bitch and pay his mortgage. Bank gets paid what its owed (from when he stopped paying + fees + costs) and he is still on the hook for the rest of the mortgage

Scenario C:
Bank forecloses on the property and pursues him for the rest. Now heres where a US legal expert should come into it. AUS law doesnt like turfing people out of their homes, but he doesnt have 30-40k in assets (including junk like TVs) to pay the rest. He MAY lose his WAkhando over this. The positive is, after a few rough months, he could find a place to rent with MUCH LOWER costs and live there, building his bank account (keeping what is left over from the liquidity of the WAkhando minus the 30-40k) and buy a new place in a few years with 0 debt. He could very well pigroach his way to this outcome. He makes 100k+ remember, low costs of living in a rented place means he could buy a place in 7 years (when credit is back to normal) with most (if not all) of the purchase price from his bank account. This implies he knows how to save and not splurge but you know.
Just because the lender wins in CT court doesn't mean they can go take his stuff in WA. They'll have to take additional steps to go get the money judgement enforced against out of state assets and income. If they try to take his condo or anything he will have to file for bankruptcy to protect it, otherwise it's fair game. Nothing is automatically protected just because he needs it or because it's important to him.
 
It strike anyone else as weird that the demand letter hasn't been delivered in almost 3 weeks? Makes me wonder if they tried to deliver it, which I believe requires some form of signature, and Phil hasn't accepted it (by virtue of refusing to answer the door during streaming). Also added the link for tracking to the OP.
The gated community comes in handy once again, keeping out all the detractor couriers.

See this is where I need a US law expert to come into it. It could take a while, but I can't see why, if the bank was really that determined, they couldnt go after it. I don't think its immune, but I do recognise it could be difficult

I highly doubt his parents are taking care of this for him. If the rest of his story about the marriage trip is true, he told his mom he would walk away from the condo since it is costing him so much. Now, the way he worded that is up for debate. I doubt he flatout told her he was going to just renege on the homeloan. He probably said something like he'd "Take care of it" or something. They gave him money for the tax saga and I highly doubt that they have this type of money lying around unless they are not opposed to draining their 401ks to bail their almost 40 year old son out of a horrible decision.

My guess is that they don't know he is letting it go into foreclosure, and if they do then they are absolutely exceptional for not talking him out of it.

Also, Phil is playing this off because he doesn't really know what he got himself into. He thinks foreclosure is just a black mark on your credit report.
 
I really like how he was just like "You know bankruptcy or whatever". Like Phil, you don't just get to go to court and say "BANKRUPTCY!!!" and they don't ask any questions and just forgive your debts while tanking your credit. You will be asked to prove you're bankrupt, and they don't mean "oh man I'm so poor I can only go out once a week and eat an expensive meal with my beard- er- wife".

Where exactly did you hear this theory? The boss of the multi-million dollar helicopter parts manufacturing plant wanted to buy a one room condo. Seems legit.
I don't know how it works with that potential amount, but if Phil doesn't get his bank account tapped and siphoned, and he keeps from paying, the bank will just sell the debt to less savory collectors. Phil can worm his way out of paying, but his phones will be blowing up as they call to collect. For a guy that values peace of mind, he's going to call it gang stalking or something.

The silver lining is that the second owner of the debt may be willing to cut a deal, or even the bank itself, and he could get what he wanted (debts killed at significant discounts). Even settling hits your credit report though, and he's going to have credit problems more than cash problems due to this.
His mortgage already got sold to this bank that's suing him.

I can't imagine what was said, but if Phil told the first bank to fuck off and he wasn't paying them, they probably were upset. A few months later they sell his debt to another bank who immediately sues him for foreclosure. Sounds to me like the new bank doesn't play games.

If Phil doesn't have an attorney (he doesn't) who is going to bargain with the plaintiff's attorney for a deal? Phil is waaay too busy for that. He will end up paying whatever they ask because he is lazy.

Current payment data if he got an FHA loan at a ballpark going rate in April of that year. The rate could have changed by the time he bought it in June.

This is a non-issue. He'll get forecxlosed, have to owe some money, then file chapter 13 and go on with life.

Like most things, this will just cost him money. It won't end him, not even close. Mostly just another bad idea that he'll get bailed out of by the kids who watch him. If he ever has to file for bankruptcy then he'll have someone basically slapping his hand whenever he reaches for his wallet until his debts are paid. It's not a situation he wants to be in.

If he's trying to refinance the WAkhando still, I imagine this would make it much harder.

I want to hope you're right, but he always manages to get away unscathed.

One of two things will happen:
  • he will not owe the difference between what he owes and what it sells for and it'll be out of his hair by like 2021 but he'll have to pay tax on that forgiven debt
  • he will owe the difference between what he owes and what it sells for and he'll pay part of it through bankruptcy by like 2026
He would normally continue paying for it until mid-2039.
