There are two new criminal files in Court Services that come up after searching for Yaniv. Both are “limited access”, which is the usual for sex crimes, especially those involving minors. The limited access is on two new files. The search will bring up all criminal files in Provincial Court linked to Jessica Yaniv, but you can’t see the details. Depending on the case, you can sometimes access some more details if you go to the courthouse in person.

Of course, if it were regarding that JY would be giddy on social media instead of going on about his mental state being so fragile right now. Something has gotten him upset. I don’t think so - those “charges” aren’t about to be approved by a judicial justice of the peace, nor would the Crown ever let them proceed.

Minors, stayed charges, dropped charges. I imagine that if JY did get slammed, these might be involving current minors. Although, AFAIK, I believe that if there is a person in a case who was a minor at the time of the crime, their identity is protected as well.

Very basically, a citizen or organisation approaches a justice of the peace to present evidence on each element of the alleged offence. The justice then sets up a hearing with a judge to determine whether there is evidence on each element of the offence, and if approved, and if the Crown does not intervene and terminate the charge (called staying the charge) then it is allowed to proceed to and go through court via the criminal procedure.


Eta; I don't get what JY thinks hes gaining from lying about the Limited Access files. If it really was involving Donny, wouldn't the same files be on his name as well?

Not familiar with the search mechanism, but ...

Can a distinction be made between accused (criminal case)/respondant (civil case) and claimant (civil case only, I guess, seeing as the prosection in a criminal matter would arguably be the state/province/whatever one calls that in Canadian).

Obligatory "not a lawyer - and arguably making a huge tit out of myself as a result". But, assuming searches can be filtered by something along the lines of the above, it should be possible to tell if JY is talking out of his arse, I would have thought?

I can’t be 100% sure that these aren’t the attempted private prosecution. They’re exceptionally rare in Canada and the Crown in BC has a policy to stop them. I’m not sure when or if they would be put into the CSO database.

Technically Yaniv would be a party to the proceeding if it were a private prosecution, Why there would be two files, I don’t know. Though I think Yaniv said there were 7 in one information and 35 in another. There are also a few limited access files for Donald Smith.

On the other hand, it would be entirely unsurprising if they were charges for sexual offences against minors. It would also be a violation of a publication ban for Yaniv to speak about them publicly, but that didn’t stop the HRT debacle.

The newest one is an action against Donald Smith. Today Yaniv tried to bring a without notice application for what is in essence a restraining order. It was adjourned pending service, meaning the court told Yaniv to fuck off with this without-notice bullshit because that’s not what that’s for.

Also Yaniv filed an application to have court fees waived due to indigence.

You'd think he'd get his head down and go earn some cash to pay his way (and his debts)...if he spent the same amount of time working as he does filing claims and pebble dashing Twitter he'd have a few bob. Guess he's going to have to get by as others have to when they want something, work for a living or sell some assets.

Amazingly, he'd be howling if those waxers owed him money.
