What else can they argue? He only temporarily removed his account and all evidence....for what reason?

Ron was required to preserve evidence, not his Twitter account. It's a non issue until such time that he is asked to hand it over.

Considering they produced nothing in discovery outside of some tweets, and the io9 article, I hope the appeals goes through and this shafts them more.

I only decided to start downloading the court docs since October, so I'm missing a lot of the early ones, but I'm pretty sure emails, texts and Twitter shit was supposed to be preserved.

Yes a motion to compel, which BHBH did submit well before any TCPA was filed. Chupp straight up ignored it, and didn’t even have a hearing for it.

Video covering it, and how they violated Texas rules, and Chupp ignored it all.

Maybe he realized he was addicted to Twitter. He has liked a staggering 84,000 tweets since February.

The thing is what is Lemongrab's reasoning on why their the final order was so unfair.

You can preserve evidence without it being publicly accessible. For example, Nick saving copies of his videos then deleting his channel.
I remember this flew over Armzgurl's (I think it was her) head when she got a TDMA letter. "They want me to delete posts but to also preserve them. How do I do that tee hee lololol???" Archiving is apparently voodoo to them.

You think a lot more of Toye than I do, I guess, there's no way he saved all of his Tweets before trying to nuke his Twitter. I reckon Lemoine told him "Yeah, your Tweets and that affidavit are gonna let them breeze through appeals" so he tried to DFE while relying on his ability to not recall ever having a Twitter account to get away with it.

I have no confidence that he backed up anything.

I just wanted to let people know that preserving evidence doesn't mean you have to keep your Twitter account.

Pretty sure this would be essentially going against the "Order to Not Delete" Cause I mean that is still active until AFTER appeals are fully done, right?
And twitter has a default data preservation of 30 days, more if someone gives them a court order. this is a "why run from the cops if you didn't do anything" moment. I'm very, very much interested in seeing what lurks in his Twitter.
Would just have to subpoena Twitter for them. They will comply immediately
Is destroying digital to play discovery games a chargeable offense? Also, good luck dealing with Lazy Chupp and Silicon Valley Birds, Ty
