Wait, so they both sent it to the appeals court AND filed for a retrial? Wouldn't the appeal have to go through and decided since they decided to go that route first before they can make a judgement of retrial? Or does it not matter and they are just piling it on? Maybe I'm missing something, but this sounds like a recipe to getting everyone pissed off at Lemonhead.

At this point, it would be easier to overturn the decision on MoRoNica at least and then most of the filings would be null and voided if I am understanding this. Then again this could be a filing for if the appeal court decides to keep the rulings just like how Ty did a early appeal filing before fees and sanctions.
edit:The only thing I can think of is that Tarrant County 141st district court will redirect these filings to the CoA, but then I am not sure why they did not just send this filing out to them in the first place. I have learned that overloading the court might make them say "fuck it" and dismiss it like this one, but now the defense is actually giving a good reason to have Chupp tell the appeals court "You know what? I think I made an error on the judgment and actually think this should go to a jury". since that would null and void a lot of these other requests.

Honestly the person who responded to Terez was being pretty reasonable and isn't a fan himself. I do agree that some MJ fans can be overzealous to the point where they get loony, but I do remember people comparing Vic to MJ when the accusations started. There are some similarities here and there but the difference is that MJ is dead and there are people trying to erase him from history based on accusations from people who defended him while he was alive. Vic on the other hand was surrounded by people who were jealous of his success and hated him for being a conservative christian. Both of them were genuine good people which is why I find any rumors about them ridiculous.

This is incorrect.
They want a retrial insofar as the awarded fees and sanctions, not a redo of the entire TCPA. He's trying a pick-and-choose strategy, in that he cites absolutely nothing giving him the right to request or demand a new. More to the point, he specifically states the following:
"A trial court has plenary power to granta new trial, or to vacate, modify, correct, or reform a judgment within thirty days after the judgment is signed."
The problem here? Once the final order was put out and the appeals court accepted Vic's appeal as timely filed, the trial court loses plenary power. Further, this motion was filed on 26 December at almost 2000, and the final order granting fees and sanctions was signed 25 November. Even if the court retained plenary power, the motion was filed on the thirty-first day, which means it's outside that window. Essentially, he's filing a motion to reconsider outside that window, and then missed this window as well.
