Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

I think we need a new word

Chupped:
verb
1, fuck someone up by willful negligence/inactivity.
2, being ignored/abandoned by someone breaking a commitment
3, avoid doing your duty
...

Example:
- Oi, did mike come and help you clear out the appartment as he promised?
- Nah, he chupped me.

Ordinarily, things like fee decisions are subject to a pretty high standard of review. This is when the trial court provides a basis for its reasoning in something called. . .findings of fact and conclusions of law. That's what Lemonhead asked for, as he's legally entitled to do. As much as I shit-talk this guy, this is one of the things he's completely, legitimately entitled to ask for, and the law straightforwardly says Chupp has to do it.

And look at what Chupp is doing.

Chupp is a DICK. Let's not make any bones about that. Unless he produces such a document by Monday, he's literally just blowing off the law and is a scofflaw judge who feels himself entitled just to ignore the law that binds the rest of us and that he has the power to enforce.

Everyday that Chupp waves his dick at the defendants is another day LawTwitter has to defend Chupp as a good judge.

At some point, some kickVic people might start wondering "this Chupp guy isn't a good judge."

And the doubts creep in.

“Look up "chupp" in the dictionary. You know what you'll find?”

“A picture of me?”

“No! The definition of the word chupp, which you fucking are!”

They really didn't consider that their little TCPA games wouldn't come to negatively effect them.

I'm still thinking he doesn't do it at all. I might be biased because I just want to see the meltdown if he does just blow it off.
The question to ask would be are there any real consequences for Chupp if he blows it off? Blowing off the original deadline just meant he got an extension that coincidentally moved the deadline to after Christmas and New Years. So of course he blew it off. So what about the new deadline? Any consequences to him that would actually mean something, or is fear of embarrassing himself to the appeals court the only reason Chupp has to do this part of his job?

I mean I'm sure there's something Wick Phillips could do but it would be kinda insane.

What would be the penalty for ignoring a writ of mandamus? There has to be some kind of enforcement mechanism. Would the higher court just hold the derelict judge in contempt?

None. Literally none. Precedent says a failure to produce these findings of fact and conclusions of law is a basis for a finding of abuse of discretion but if you look through Chupp's history, abuse of discretion is more or less a description of his entire judicial career. That's what you need for a writ of mandamus, and he's had those, too. He just is the king of not giving a single shit.

He hasn't done that. He just doesn't care about the process that leads to him getting those. He couldn't care less. He'll just deliberately make wrong decisions out of pure spite, apparently, and then just cope with the inevitable reversal by the appeals court.
