I understand that you’re suing over judicial fraud? Can you kind of walk through how you’ve come to that conclusion and what evidence you might have for it and maybe what steps you’re hoping to take to get a favorable resolution?
Under the law (which you may already know?), you can't sue a judge in a judicial capacity for a ruling. My only recourse is to (potentially) report the judge through the judicial complaint process.
I reached this conclusion because Rule 9(e) mandates that pleadings shall be construed to secure justice. As I demonstrated in my appeals, the judge did not apply all relevant case law to the pleadings. Therefore, the pleadings were both construed to secure justice. If the pro-se forms mandate that a pro-se litigant cannot cite laws, that does not mean the judge can just omit relevant case law, which is what the judge did.
Additionally, as I noted in my Sup. Court petition, the Appeals court misquoted my appeal statement.
The lower courts also did not apply relevant case law which mandates that if a pleading has enough factual content, it should move to the discovery phase.
*Therefore, the pleadings were both NOT construed to secure justice
