I think any competent lawyer would withdraw those affidavits if things come back from appeals. They were more to slander Vic rather than stand up in court. After the TCPA it is "put up or shut up" time.

Generally Manjaw's affidavit would still need to be in the record, I'd think. Otherwise trying to get her on the stand would be like Lemwaaah trying to depose Rekieta. That is, trying to get an uninvolved third party to testify. With the affidavit, she's part of the suit and Vic has a right to confront her. If she's not, she's an uninvolved third party.
