Calling it now, Phil will definitely not show up again after reading this post.

I am really curious to see how, if he does call in, he explains the stream not starting on time, since the call is supposed to actually start at 10:30 AM. Given that MidFirst is challenging him, I would expect (right @AnOminous?) that Lance (or an associate) will be on the line to try and ask questions about his income and expenses, so it shouldn't be a fast call, unless the trustee just blows it up and dismisses the bankruptcy.

I'm actually not sure what their best move is. They still might just not appear, leave it up to the trustee, and then pounce on anything Phil has left in the absolutely shitty shape it's in. This meeting is for their convenience but that doesn't mean they will want to show up.

I'd assume the trustee is going to be going in on Phil, though. It's interesting everyone else was continued.

Almost like the trustee decided she wanted to spend the time scheduled for everyone on this specific case :optimistic:.

unless the trustee just blows it up and dismisses the bankruptcy.

The trustee would have to file a motion to dismiss, since only the judge can do that.

Such a motion would look something like this (stolen from Kentucky):

UNITED STATES BANKRUPTCY COURT
FOR THE WESTERN DISTRICT OF WASHINGTON

______________ Division

In re:

Case No. ________________

PIGROACH

MOTION TO DISMISS CH. 13 CASE

The trustee asks the Court to dismiss this case because

[ ] the debtor(s) did not appear at the §341 First Meeting of Creditors.

[ ] the attorney for the debtor(s) did not appear at the §341 First Meeting of Creditors.

[ ] the debtor(s) did not timely provide the documents required by the Court’s Order to Debtor.

Also to @Comma will you be updating the first post to show the events that have happened after he skipped the initial court date? Specifically MidFirsts motion to collect on the Connecticut property as well as the 26th hearing taking place via phone?

Done. Added the rescheduled/altered 341 Meeting and MidFirst's motion as an update at the bottom of the OP.

Lol someone said it here, I don't know. Maybe not.

I'll take a look later. It would make sense that he would be a focus given the details of his financial situation, but it's probably good to double-check. If someone else beats me to it, feel free to post up whether or not everyone is doing a phone call on the 26th.

Interested parties means parties in interest, i.e. people who would be entitled to appear in court or be represented by counsel. It does not mean random gawkers.
Is this actually going to be a problem? You can find the phone number and password in the document itself, youtube videos/comments, and reddit at this point—they redacted it in some twitter posts I saw—so I suspect a lot of people will call in.

Either way, I'd agree with the notion of anyone here not to do so. These calls are public record. If the audio itself not available later, the written transcript will be posted anyway.

Good man, you think he's gonna welch again this Thursday?
Lol, no idea, to be honest. He sure is acting like it's not happening, so I wouldn't be surprised. Then again, it could also be a 15-minute telephone call that causes him to start his stream a tad later because he "had to do some behind the scene stuff" and be done with it. So in that case, Thursday's pre-stream will be very telling if they really asked him the hard questions @LyteSydeByll's contact who was present at the court mentioned.

Seriously. To any re.tards out there considering calling in--don't. There's going to be an audio recording (and probably a written transcript), so there's no need to go ultra-sperg and do it yourself.

I'm curious to see how he plays it given the 10:30 AM start time. That's right when he turns his stream on. So maybe he'll just turn the music on and then let that go for as long as it takes?

But let's say 100 detractors call in, and, miraculously, every single one leaves their phones on mute, would this be a technical problem for the telephone conferencing system? Would they notice? Because I don't think it's realistic that everyone will heed our warnings at this point, the information is too widespread.

I'm worried about exactly that. I guess we'll see whether they're actually okay with it but they're likely to wonder what the fuck is going on when a bunch of speds call in.

Yeah, they're gonna notice that more than a few people are on a call, especially for someone who is, as far as they're concerned, a nobody.

I am a bit confused by that. The document states that the attendees should call in at 09:00 o'clock. Will they'll be held on hold for about one and a half hour then?

They will most likely ask who you are when you call in. I don't think it's going to be an anonymous call-in free-for-all. They might promptly kick you off the call if you say "I'm a journalist following a public figure's bankruptcy here," and they might not.

A 341 hearing is generally open to the public. You'd think its telephonic equivalent should be, but nothing explicitly says that it is. I just expect some SoK type autist to call in and try to stream it or do something idiotic like that.
