Victor Mignogna v. Funimation Productions, LLC, et al. (2019) - Vic's lawsuit against Funimation, VAs, and others, for over a million dollars.

I have neither the time nor the booze to go through all their crap again, and after seeing that I don't have the inclination either.

The only marginally interesting bits are from the cross-appeal. Picked from among other whining:

Isn't that a lie? I thought MoRon did not answer discovery, and BHBC had a motion to compel on the table when the whole TCPA thing happened.

Besides which, these fuckers were the ones who waited until after the depos, because the only "proof" they had of anything were scraps they twisted and mis-interpreted from Vic's depo.

Yup, they never answered the interrogagies fully and breached TRCP by filing random objections to each question, and the the fact they were deposed at all is their OWN FAULT! There also Was a Motion to Compell, but Chupp just ignored it, and never ruled on it.

The reason no one else was, was because they filed their TCPAs to block discovery.

Lemoine as a TCPA "expert" didn't file his TCPA until After he committed discovery abuse, and had the depositions done. Then only filed the TCPA once Marchi, and Funimation had.

Those expenses are entirely their own fault, and could be argued to be incompetence as a TCPA expert firm, or purposely trying to run up the bill.

Well, I can't drink alcohol right now so I'll just wait for someone who can to do a 5-hour video in 2 parts about this abortion of a document that sounds like it's gotta get striken out because it broke so many rules for documents on their courts.

I'm with other kiwis. I hope the judges are able to get past all the appeals to emotion that the documents are drowned in, and get the nitty gritty facts, and cross-check those facts with the actual court documents to throw out all the lies and stuffs that weren't raised in said case.

What's sadder than this stupid Beautiful Mind shit is that they probably sent out an email to the twitter spergs telling them where to find the word clues so they look epic cool and popehat touches their peepee.

If they want to spend time inserting secret messages to spazmoids in the brief instead of actual messages for the appeals court, fine with me.

You get both.

If you read the rules in context, I believe both MoRon and Vic are involved in an appeal separate from the other parties and get words for that, too.
Yes but how are they counted is what I don't understand, it's one document for both the appeal and counter appeal, does this mean that all the words in the document are split in half and each count added to both counts? Or is the entirety of the word count added onto each word count?

Edit.
Um... Okay. Is "control" a shitty Spednaught meme we're supposed to be aware of? Or did he realize he had 5 out of 7 letters by coincidence and just changed things for the hell of it?
it's Ron threatening the higher courts, either that or Ron was threatening his firm and it's a call for help.

Check 9.4. I think there's a whole allotment of words for any party in an appeal. So if you're in an appeal and a cross appeal, you get both allotments. So 27,000 words for all parties for each appeal as an aggregate total of all legal argument filed by the party.

Just as I thought they couldn't possibly stoop any lower, there's this nonsense. And I thought the tables of contents was embarrassing. Maybe they should insert symbols and Morse codes in there too. Include memes and Gifs as well. Even a hashtag could strengthen your brief.

Isn’t it convenient that the person who would catch wind of this is the shoe sniffer himself? Shane Holmberg, the same guy who uploaded all those briefs on his google drive. Absolutely not a coincidence at all, no way.

Between Ron’s conversations, Lemoine's obsession with Vic's GFM and now this, you would think there’d be no more comedy gems from Monica, Jamie, Ron and their buddies. I of course will be wrong. Ty and his legal team have to be laughing their asses off back at the firm. Can’t believe this is the best they could come up with. How embarrassing.

yes she most certainly is

Perhaps they realized they're fighting a losing battle and just decided to use appeals to shitpost? If they aren't intentionally doing this then that's even worse.

... So reading through it, they are actively litigating the idea as if to a lower court. Additionally, they are defaming Mignona again using the privilege of the court to get away with it.

No, the appeals court is going to hate this. They got away with it with Chupp because he was too lazy to bother to read through the small trees worth of paperwork. But all the appellate court DOES is read paperwork, meaning they get to see this and see it for what it is. Defaming someone. Hell, THIS DOCUMENT is an example of the defamation that was dismissed.
