I just want this to get converted to Ch. 13 (because he understated his income) or dismissed with prejudice (because of the fraudulent way he achieved that lower income). People e-mailing the trustee with all these stories about statues, electronics and fancy househould appliances might fuck this up for us. Sure we'll get some laughs if his shit gets taken and sold, but we're looking at multiple years of prime lolcow material if he's put on a payment plan or gets eaten alive for ALL his debts.

I want it dismissed so I can see immediate pigroach suffering but I want Chapter 13 even more because I want to see him squirming for literally years as they get to poke him over and over again on the public record when he fucks up, then he'll lose everything anyway after fucking up the last time.

Phil is incredibly stupid filing that bullshit early (money for cat food but no pets), and the utter nonsense (no electronics). If you're going to try a huge lie you have to go big or go home. If he was going to do that he should have got absolutely everything perfect and instead of hiding the gacha shit, actually declared a huge series on WWE Champions and made it all completely public and then claimed his choice to spend all that money was just a bad business decision, not fraud. That, as crazy as it might sound, might have actually worked.
 
How far back of income is required when filing? Will Nancy show the creditors he made 100k last 2 or 3 years while still not paying debts?

I thought of an out for him. If he liquidates the WA condo he could keep his car and live out of it.

If your income has drastically changed during the six-month look-back period, you may be close to passing the means test, but older income is preventing that for the moment. If that's the case, waiting a few months to refile may be your best strategy. However, keep in mind that a Chapter 13 plan does not necessarily require you to pay 100% of your unsecured debt before you are discharged. You might prefer a Chapter 7, but you have no guarantee that you'll eventually qualify for one, and a Chapter 13 payment plan might be better than going without any relief at all.

I believe Nancy actually asked for six months of statements during the creditors meeting. This took place during an exchange where Rochelle said she only provided 1 month's worth. I'll bet $0 it was because she wanted to run the means test against Phil because she suspects abuse of the Ch 7 process. Another strong indication this isn't going to end well for Phil. In order to do that, Nancy is going to need numbers from all kinds of records like Phil's tax returns. It's almost a virtual guarantee she is going to find irregularities and numbers that don't add up.

I don't think his thought process was any more complex than "I'll just tell them my earning are low enough to qualify for Chapter 7, they'll wipe my debts, I just keep on as normal".

He's still in the entitled mentality of what he calls the "wild west days" of internet personalities back when companies like Machinima would drop 300k a year on some schlubby Pollock with an oddly shaped head to sit on a couch in 480p while you have people who went to grad school, lawyers and doctors and engineers who might be lucky to make that much after several years of establishing themselves. Then again they'd be smart enough to have a portfolio and have part of their money invested wisely so there's that.

Actually I've really wanted to hear from him HOW exactly he got in this position. It's not like the trolls blew away thousands on 'business expenses'. Considering trolls didn't really fuck with him financially, and he tells sponsors they'll get trolled when they work with him, how the fuck are the trolls blamed for any of this?

To be fair he has on multiple occasions admitted that he made very poor financial decisions, and says moving across the country was the worst mistake of his life, financially.

He also admitted to excessive credit card spending and said you should never use credit cards, so I think he actually knows exactly why he is in the situation he is in, he simply has zero ability to rein himself in.

Seems like he plans to not show up because he dosen't want to keep CT condo anyway. This is fine if not for the fact he might have to pay the difference of $50k or more......

I have this inkling that he made the meeting only because one of his creditors got aggressive (he wasn't paying for the CT khando for 6ish months before his first meeting) and he panicked. If they werent aggressive, I could see Phil still not declaring bankruptcy until the very last possible moment

His line about foreclosure was previously "let them foreclose and take my property, fuck 'em," so either he found out they'd come after deficiency and he filed before they could do so, or he realized he was still insolvent even without the Connecticondo.

Surely they would have contacted him prior, threatening legal action. It's requirement for my jurisdiction to have court as the last step to solving the problem. Includes letters back and forth, ADR etc

In his telling the lawsuit threats started almost right after he stopped paying and he was in negotiations with the bank up until they filed to foreclose (one struggles to imagine why MidFirst would turn down a generous offer of "get bent"). Since the foreclosure filing was in late November and he claims he started meeting with Rochelle in October, it's totally possible that MidFirst told him privately they were going to sue for foreclosure and just didn't file the paperwork until November.
